I was at the mall yesterday evening walking to Sears from the parking lot and saw someone OC'ing not a problem at all. But I am thought you couldn't carry in the Mall. The guy was going into Dillard's lower level so I looked for signage not to see any at Sears so my ? is was he legal or not? Just trying to get what is right and not right.

If its a parking lot entrance store, then if there is no signage, you are allowed to. Keeping in mind that they can still ask you to leave if its against policy. Isn't Valley Hills mall the one in Hickory?

I don't think you can OC in the mall proper. The mall rules will probably say not to. You can in outlying stores with parking entrances though. I wish I could OC there, though, because I get my Cigars at Pipes LTD, there. I do wear my holster in most of the time, though. Mostly because its a belt holster most of the time (when I don't have the paddle attached, and I get too lazy to slide it off when I get out of the car.

I OC in all the anchor stores. If I have to go in the mall part I CC. Its nice to have options.

There might not be any signs on the doors, but there should be a small plaque on the wall when you 1st walk in with mall rules. See if any of those rrules say no guns.

Northlake Mall isnt posted but I had mall security and CMPD escort me out because I was OCing. They were respectful and didnt make a scene which was very cool of them. They were 100% sure the rules said no guns. So when we got to the door they read the wall plaque and checked the doors, but of course nothing against guns. The looks on their faces were priceless. They said I could conceal but since I didnt have a CHP I just left it in the car

I've OC'd in Sears a few times. Dealt with 4 employees one evening trying to buy a gift. No problems at all. Typically, I stay out of the mall if I can. With the exception of a couple trips a year for clothes shopping with the kids. None of the doors are signed that I have seen. I know the lower mall entrance at the parking deck is not. I'm sure their policy says no like the rest, but they don't put it out there.

never OC'd there but I see younger guys in there all the time OCing fixed blade knives of cartoon proportions that look like machetes

NC's statute 14-415.11(c)(8) states: quote On any private premises where notice that carrying a concealed handgun is prohibited by the posting of a conspicuous notice or statement by the person in legal possession or control of the premises. Unquote.

sorry i am not in the habit of reading small plaques to see if i am violating anything. glad you had a great encounter that ended well...

I have found that for the malls in NC, it is just easier to CC...they never post notice that is conspicuous...so it is legal.

Hanes Mall inc Winston-Salem just posted gun buster signs. Also, when you get in the door they have the mall rules posted which says no guns whether concealed or open on the premises.

I was skeptical up to this point becuase they didn't have anything posted on the door and the rules were only posted inside the mall. The rules portion never changed but they didn't have anything posted on the door until recently.

Now the question is if the Mall only has the rules and gun buster signs posted at direct Mall entrances. Then if I enter through a store with a parking lot entrance and nothing is posted, then I enter the main portion of the mall through that store there are no gun buster signs nor any rules posted. What legal standpoint do they have against CC. I know if I OC they can just ask me to leave.

I am always conservative when CC and OC if I think it may cause a scene.

Just check NCGS 14-415-11(c)(8)

You are prohibited to CC "On any private premises where notice that carrying a concealed handgun is prohibited by the posting of a conspicuous notice or statement by the person in legal possession or control of the premises."

I would argue (IANAL), that if they do not have ALL the normal public entrances covered, they do not have the entrances covered. They would have to produce video or witness statements that you entered by one of the marked entrances otherwise.
