MGM ready for a test!

I'm still trying to retire from being an independent electrician and AC serviceman. But, I just can't say no to the money; and I'm currently working 15-hour days making bank for one helluva vacation. So, anyway, I have a service contract for the elevator air conditioners on the State-owned pedestrian crossover walkways at the Strip and Tropicana. For you natives, these were the first over-Strip walkways in Las Vegas.

Because of the new corner construction going on (AGAIN) at the MGM, there is currently no public-owned sidewalk to follow the corner around. You are diverted into the MGM in order to continue to the sidewalk on the other side of the construction site. There is even a sign posted that says "Right to passage granted by MGM."

So...

Would not the MGM now be REQUIRED to allow open carry while you walk through from one entrance to the other?

I would say that so long as you are walking directly in and directly out, there wouldn't be an issue. If approached and asked to leave, simply tell them that's precisely what you are doing. They probably wont even notice you in the crowd of foot traffic streaming through already.

I was thinking the same. Of course, it takes several minutes to walk through, as the entrances are not close to one another. And it's a beautiful day, I suppose one is entitled to walk around the block as many times as they wish. I'll try to be more prepared next time I'm over there.

I think that since they have granted a legal easement, you would have the right to pass through unmolested. One wonders if they are receiving any remuneration for it as I think that would also put a whole new light on it. As NC said, it's kind of moot in that if you enter and they tell you to leave, what the hey, that is what you're doing anyway.

I'd agree with the mootness except that you are granted legal permission by to come right back in on your next passage down the sidewalk. I'm not suggesting purposefully thumbing your nose at them each time (though maybe I could), I mostly found the situation curious and thought I'd get your thoughts.

I'd wager they are not receiving compensation since it is their construction project that necessitated the closing of the public sidewalk.

I know on other properties where there is no public alternative and the private passage is the only way to get through they have been held to the public property standards. The battles with animals, handbillers, and street performers have made that very apparent.

If the city is REQUIRING foot traffic to go through, with no other reasonable option, they have temporarily reduced the casino's control of their property.

This would be contingent on your acting as if you are still on the city sidewalk -- that is, walk straight through without pausing, leaving the detour route or initiating interaction with others who are doing "casino" activities.

Even a person who has been trespassed must obey the official requirement to pass through the casino.

Expect the security guys to try to tell you otherwise. When they do, ask them what you're supposed to do when the CITY tells you that you have to go through. At that point, they should back off.

So long as you are using the most direct rout to pass, they cannot restrict you from entering; deviate or loiter and it's a whole other matter.

I agree with all that. I think the most interesting thing would be that security is still likely to say something if they see you, and then the best part is when they see you again on your way back down the street and diverted again. You just KNOW they aren't educated about anything in this regard.

I agree. Since there is no reasonable by-pass and a form of easement provided to the public, I doubt there will be a problem, even if they do see you packing.

On one of the strip meet ups last summer after using one of the pedestrian cross over bridge we ended up ocing just inside of one of the casinos. I cannot remember which casino. It was not much of a walk to the exit and no one said anything. Kind of a mute point before the law can trespass a person they are required to give a warning. With a statement, I am heading for the exit now, really nothing legal they can do unless one was not to exit after the warning.
