    Asked CMPD about open carry

    Been reading this forum and decided to join. I wanted to share my phone call today with my "Division" of CMPD. I was concerned with the GATTTOTP law, as most are, and called a lieutenant who is in charge of my area. The officer asked "Why and where would I want to carry?". I said "it would be nice when I am walking my dogs at night, or so, for defense". He said I needed to get my concealed and it wouldn't be an issue, but carrying open, there would be the GATTTOTP. (I have researched this previously) I said, "well, what all does that entail?". He told me he would "have to look it up". (I will pause here for theatrical effect for my readers....) "So I probably shouldn't?" He said, "Not really until you get that CCP." This ended our conversation and I thanked him.

    For reference: Charlotte City Ordinance (See section D)

    Sec. 15-14. - Possession of dangerous weapons.

    (a)
    For the purposes of this section, the term "dangerous weapon" shall be defined as any object or device designed or intended to be used to inflict serious injury upon persons or property, including, but not limited to, firearms; knives of any kind or type having a blade in excess of 3 inches in length, except when used solely for preparation of food, instruction or maintenance; razors and razor blades, except when used solely for personal shaving; metallic knuckles; clubs, blackjacks and nightsticks; dynamite cartridges, bombs, grenades, mines and other powerful explosives; slingshots; shurikins; stun guns; and loaded canes.
    (b)
    It shall be unlawful for any person to carry, possess or have within his immediate access any dangerous weapon while in or upon any real property owned (except property owned by the city and leased to some other person or organization), leased, as lessee, or otherwise temporarily controlled by the city, whether such property is located within or outside the corporate city limits.
    (c)
    This section shall not apply to the following persons while acting lawfully and within the scope of their duties and authority:
    (1)
    Law enforcement officers.
    (2)
    Officers and soldiers of the armed forces, militia and national guard.
    (3)
    Any person who carries a dangerous weapon onto the premises of Charlotte/Douglas International Airport for the sole purpose of shipping the weapon by air in compliance with federal and state laws and regulations.
    (4)
    Persons specifically authorized by state or federal law to carry firearms in the performance of their jobs.
    (5)
    Any other person authorized, in writing, by the city manager or his designee to carry or possess dangerous weapons while in or upon specified public property. The city manager may promulgate guidelines for the issuance of permits for the possession of dangerous weapons on public property. The purpose of the guidelines shall be to ensure that permits are issued only for lawful purposes and in circumstances which present no threat to the safety and welfare of any person.
    (d)
    This section shall not prohibit the lawful possession or carrying of dangerous weapons on the public streets and sidewalks, except as provided in section 15-18

    Seriously, the person you talked with had no clue of NC law.

    Ignore all of that "you gotta get your permit" talk and OC where ever you can legally. The more of us out there, the better.

    He also had handcuffs. I understand the law, but if he has to "google" it, chances are I will be going to uptown care of CMPD. I find it telling that he was able to throw the GATTTOTP immediately when I said open carry. This tells me that he has been told that this (GATTTOTP) is his go-to when someone has a gun, and possibly someone has complained/called CMPD about that gun carried openly.

    I believe in open carry, but Charlotte is another can of worms.

    I would be interested if anyone had a story of interaction with CMPD and open carry. (Recent)

    I understand completely. While it's easy to sit here and tell people to go out and buck the system at will, it's harder to do when you're the one that could face charges lol.

    Sadly, it will probably take a civil court case against the city to change that mindset there. In order to bring the civil suit, someone has to be the one who has his civil rights violated via a wrongful arrest, etc. Not many can afford the time, cost, and loss of reputation it would take to go through that entire process.

    I certainly don't suggest going out and taking that burden upon your shoulders, I was just pointing out how ridiculous that officer was in his response and his lack of knowledge of the law, that's all

    I open carry in Charlotte all the time. What is your area of operation? Chief Monroe has a behind closed doors policy that anyone open carrying inside the 277 perimeter will be arrested and the lawyers can sort it out. If the chance of being charged with a crime is too much to bear then by all means do not test the system. An officer call arrest you for GATTTOTP but it will be up to the Magistrate to charge you.

    if mem serves...dreamer i think posted, i believe, on the NC thread for anybody to produce viable evidence where anyone in the state of NC has been charged and convicted of the crime GATttttttt....?

    nobody could find a case

    i have tried to research this but have not been able to adequately get the search function to search...

    will continue my quest...

    The key words there is charged and convicted. Plenty of people have been charged, The kid that was walking on the sidewalk with a rifle in the Charlotte University area and the guy that posted here about going into the bank were charged. If I remember correctly the rifle guy plead to a lesser charge or something and forfeited the rifle to make it go away. Didn't the bank guy eventually get the charges dropped? The powers to be like to use that charge because it is all scary but at the end of the day they know it wont stick.

    Just make sure to have a secure recording going...

    I talked with a CMPD officer that I do martial arts with and specifically asked about GATTTOTP and such. He said he would not give problems as long as the gun stayed in the holster. I then asked about the MWAG issue, and he said he would only consider that charge if it was someone shooting a BB gun or someone who had their gun out.

    So, back to square one. It depends on the officer and his attitude. And to NC Heel, I live near Park Road shopping center. Not a high crime area, but who knows when trouble will come looking?

    When the story was still current, CMSO blotter showed him arrested and booked. I wish I could remember the charge, but allergies are killing me. I never published the link because it has his photo, name and age.

    Yea this is a bad time of year for them, plants blooming and all.

    I am sure something took place but I am just interested if he was actually charged with GATTOP as we all know how that turns out for prosecutors. Charlotte has a carry law for Charlotte real-estate, if he was on the city property I would imagine that could have been what he was charged with. IMO I don't think that charge would have even held up, unless roads are considered real estate.

    GATTOP is one thing that just does not concern me, the elements of the crime just are not that easy to commit, unless one is actually going about terrorizing people.

    I can say that it was NOT GATTOP on the blotter...might have been brandishing or something similar. I know the area where he was arrested pretty well, and if he was in the streets much, he would have been on a different website after be scrapped off the pavement.

    Perhaps tCan can pipe up since it was his case?

    You shouldn't have any problems with that area. I been all over South Blvd. and the Tyvola Rd. area. You have to expect a hassle if you go Uptown (i.e. anything inside the John Belk I277). You may get hassled in Pineville if you make it that far south. I used to work over on Independence and had plenty of LEO encounters with no problems.

    You are incorrect, It was GATTTOTP. Sitting here looking at the arrest sheet. There was also a resisting charge. I have also read the incident report and the charges are BS. Can't site because the last time I posted it I was chastised for posting someones personal info.

    as far as GATTTOTP convictions. i think the guy in Burnsville, NC was convicted of it. not sure about that though

    but i want to address TIGER. first welcome to this site. you have learned one of the third or fourth lesson that we get here on this forum.

    never , never, never, ever, never, etc, etc, ask a LEO about the law. they do not know. if you must, ask a "gun" lawyer, DA, or AG.and look it up your self

    well , not saying LEOs lie, but they might not tell you the truth. there is a thing i like to call "functional intelligence", it is just enough intellegence to funtion. they will not go beyond their training.
