Kid + Airsoft = possible 7 years

The article and through it, other articles, does not state the exact type of Airsoft. If it was clear or brightly colored plastic or if it was a realistic look-alike.
Assault, not by letting his kid shoot a tree or fence, but by letting the kid ride around pointing it at others... P*ss poor parenting.

At first glance, I'm thinking, omg let kids be kids, it's a toy.
But as I thought about the situation, both as a parent teaching my kids gun safety, and as an open carrier... how would I react to it?

Now, this guy's daughter is 5 and his son 3, so I would assume toy and look into the situation, but if it was older kids with a realistic Airsoft?
Pre-teen & teen is also pre-gang and gang... would depend on how they are acting. Kids having fun or wanna-be thugs standing around trying to be tough.

I'm not anti-government, but I am anti-nanny state. I will not go to NY or CA, ever.
I agree there are a lot of nanny laws out there, but with this... idk.
Get the kids Nerf or Super soaker water guns... kids can have fun, and they won't be mistaken for real and get the kids shot by nervous LEOs.

Thoughts?

I would probably be shot by a 5-year old before I could convince myself it was a real gun they were shooting at me with.

That said, the parents should be fined substantially, given probation for a jail term, and if the kid had been told better already, time for a spanking.

Caveat: I have no kids, and never will; I can't pretend to know the difficulties in raising one.

Didn't these morons notice that when the gun shot there was no bang!? Total idiots, almost every kid in the 50's would be in prison if people were as deluded as they are today. Every citizen with common sense should move from that nanny state and let it sink.

Forget the 50's; the kids of the 80's would have been locked up, too. My friends and I all played "War" growing up, had the Rambo toy guns, etc. Back when they looked like guns, too.

I have a couple of points. First, this is a gross overreaction to a non-event. I'm still not clear exactly what statutes or laws were broken. He was stupid to resist after he was arrested. That never works.

I recall having a what appeared to be a fully functional MAC-10 cap gun when I was maybe 10 or so. It used the rolls of red paper caps - you know, the ones where you could scratch them with your finger and they would pop - and was battery operated and fully automatic. No red tip, no orange color. Just bad ass. And it smoked like crazy when you fired. It also had a suppressor on it, and the caps made a good bang sound. Played with that thing all over the place - in my back yard.

Anyway, second, and most important point. We as responsible gun owners need to teach our children that anything that fires a projectile, be it a bb, a pellet, a plastic dart, whatever, needs to be respected. My daughters are going to get either a bb pistol or an airsoft soon, and the point is to teach them proper muzzle control and proper respect for a firearm of any kind. We would not take our weapons to a park, pull them out, and start shooting at a tree. I get that it is not a real gun in our sense, but proper training and respect needs to start early, and those parents should have had more sense in that regard.

I'm guessing the slide would be way too strong for the girl to operate, so if he had already fired it since last rack, she could not possibly make a shot? That could be why he gave it to her without worrying.

Airsoft could hurt an eye of a kid though, so even if it was technically safe, he could have warned her not to point at people. Maybe he did, who knows. Whether she actually pointed it directly at any two years olds is questionable because any witnesses who fear a toy gun after knowing it's a toy are not credible.

7 years...even 1 year...even 1 day...even 1 dollar...ridiculous. It was a toy, no one was hurt, no one was going to get hurt, probably there was technically no possible way for a projectile to discharge.

Some people pretended to be scared, because they felt they should be offended by anything gunlike, or else they were truly scared at first and then unwilling to let it go when they found out there was no danger, again offended and made to feel by media that anything gun-shaped should be punished.

People should not put up with this kind of fear mongering by media and government. :cuss:

Is there any way we can help this guy? To spend the bigger part of a decade behind bars for using a toy in a park is beyond belief. I assume there's a code that lumps all air powered guns together?

This kind of thing could happen to anyone, because essentially these are thought crimes (picture of a gun, toy gun) and when the danger is imaginary, it doesn't matter if you didn't actually do anything irresponsible.
