TO ALL PISTOL PERMIT APPLICANTSAND LOCAL ISSUING AUTHORITIES,

The FBI biometric fingerprint backgound unit in West Virgina has confirmed today that results are transmitted back to the Connecticut Department of Emergency Services and Public Protection within 24 hour after they are received.

Cathy in West Virgina was very helpful in explaining the process and any situations that would cause a delay in the automated process.

There also seems to be a documented substantial delay in the period between when the state receives the results of the National Criminal History records check and the date they send and provide it to the local issuing authority.

It also appears, (yet to be confirmed), that the state stamps a date on a document supplied to local issuing authorities which may mislead local issuing authorities into believing the National Criminal History Records Check was completed on or just before the stamped date without any notice that the results could be six weeks or more old.

Alot could happen in the six weeks and presents a very serious situation regarding the timely accurate background of an applicant. I'm sure that local issuing authorities must believe that the information received is recently generated when they receive the results.

The DESPP/SPBI unit in Middletown should NOT be allowed to delay transmission/delivery of the National Criminal History Results to local issuing authorities.

MORE INFORMATION AND FACTS WILL BE POSTED AS RECIEVED.

How many times have we called and DESPP always says that the delay is due to towns, the feds, the moon, etc.

We know.

Good to have facts supporting this ...

Too bad there isn't a way for all the pending applicants (post 8 weeks) to file a class action lawsuit against the state? Or even against the towns for that matter... all for one and one for all?

you have to exhaust admin actions first ? ... so it would need to be folks who went through the BFPE ? Of course, they cannot grant you a $$$ settlement

We will certainly explore this as a possibility at some point, but it is too early. We need to collect data (http://ctcarry.com/PermitTimes/Add). We need to make sure as many people who are being delayed are also appealing to the BFPE, etc.

Unfortunately in Connecticut, we end up with too many people dissuading people from appealing or giving them improper interpretations of the law (see the many arguments here about 5 days, 1 week vs 8 weeks). This results in an artificially low appeal backlog with BFPE which is only going to hurt the case that the local PDs and the state are massively harming the residents of Connecticut.

These fights are long term fights, and we are in it for the long fight. Ed Peruta has been working on permit delays for many years before Connecticut Carry was founded, and we have seen plenty of progress. Things are getting exciting, because we are now truly honing in on what the problems are and who is responsible for them.
