Mr. Starks –

Thank you very much for letting us know about your experience here at the Pike Place Market. We do honor RCW 9.41.290, and have reviewed this policy with our security staff.

I hope that the rest of your visit to the Market was enjoyable.

Best regards,
Kelly Lindsay

I apologize if I'm being dense, but do I understand correctly that the Seattle Aquarium, even with the SAS being the operator, cannot ban the carry of firearms on premises? This is from their Quick Facts page:
The Seattle Aquarium operates as a nonprofit 501c3, through a long-term operating agreement with the City of Seattle Department of Parks and Recreation.
I think this is the contract, which includes:
2.2 Permitted Use. Throughout the Term, SEAS shall use and continuously occupy the Premises for the operation of a public Aquarium and for purposes and programs related or incidental thereto, focusing on conservation, education, enterprise operations, and visitor services, and for no other purpose. SEAS shall not use or occupy any portion of the Premises, and shall not permit the use or occupancy thereof, in any unlawful manner or for any illegal purpose, and shall not permit any activity to be carried on that would constitute an actionable nuisance under the laws of the State of Washington. The Permitted Use shall not include the sale or the promotion of the sale or use of tobacco, weapons or alcoholic beverages (provided that alcoholic beverages may be served at catered events and in the restaurant area) and SEAS agrees to adopt and implement a policy prohibiting any person, except for law enforcement officers and on-duty security personnel, from possessing firearms on the Premises.
That's BS, right?

I have opened carried at the Seattle Aquarium a few times, without issue. I always felt that state preemption would apply as its a city owned building and they are only out managing the operational items to SAS.

Edit: Just found this older thread (2010) regarding an OC experience at the aquarium. I had no issues but YMMV.

Yep. Here is someone I know who OC'd there.

Yeah, I read that thread before I asked, but the agreement between Seattle and SAS changed since then. Specifically, SAS went from being a support organization to being the operators of the facility.

I was going to OC there, today, but my wife isn't yet completely comfortable with it. Since she was there, I CCed for her. It's sad that Texas is so anti-gun that even a girl who grew up in West Texas has to get used to her husband OCing. It's not that she has any problem with guns or carrying, it's just that OC is completely foreign to her. She's coming along quickly, and I'm sure she'll be fine with it very soon.

Understandable, have her come to some meets and meet other OC'ers I found that is the best way to get people to see it is no big deal.

My brother-in-law is moving up here very soon (with my sister and their kids). I think he'll join the OC life, and having the two of us doing it will normalize the behavior for her very quickly.

Seattle's contracts with other businesses

PNSPA v. Sequim notwithstanding, a provision in a contract between Seattle (or any other municipality or similar entity in Washington) and a private entity cannot, as I see it, skirt state preemption in an effort to disallow possession and/or display of a firearm in publicly owned premises. As such, paragraph 7.2 in the Museum contract, and paragraph 2.2 of the Aquarium contract are void as a matter of law.

Re-read the provisions of the contracts. They are requirements by the City for the lessees to disallow lawful carry. They are CITY requirements and, as such, are violative of RCW 9.41.290. As I read it, PNSPA is a very narrow holding limited to sales preclusion.
