    Openly carried FIREARMS near Appleton farmers' market lead to police, debate.

    BREAKING public access. The news set free of special interests!

    The men, Charles Branstrom, 28, and Ross Bauman, 22, also were wearing holstered handguns. About six minutes after they are stopped, one officer sees Branstrom's camera, confiscates it and attempts to turn it off, but stops only the video. The device continues recording audio of police officers for about 45 minutes.

    Bauman has two counts 947.01(1) Disorderly Conduct pending (Marathon County Case Number 2013CM001537) despite 947.01(2) and an extensive rap sheet. Nothing listed on Branstrom.

    947.01  Disorderly conduct.
    (1) Whoever, in a public or private place, engages in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under circumstances in which the conduct tends to cause or provoke a disturbance is guilty of a Class B misdemeanor.
    (2) Unless other facts and circumstances that indicate a criminal or malicious intent on the part of the person apply, a person is not in violation of, and may not be charged with a violation of, this section for loading, carrying, or going armed with a firearm, without regard to whether the firearm is loaded or is concealed or openly carried.

    At approximately 8:56 AM, on Saturday, September 7, 2013, the Outagamie County Emergency Dispatch Center received three 911 calls. Each of the callers reported seeing two males, walking eastbound on West College Avenue, in the direction of the Downtown Appleton Farm Market. The callers indicated concern as they reported each subject as wearing either an assault rifle or machine gun on their backs. Appleton Police Department officers responded to the area and made contact with two individuals in the 400 block of W. College Avenue.





    Due to the nature of the call, combined with the officers’ observations of the subjects walking toward the farm market armed with rifles, they were briefly detained at the scene. The firearms were identified as AR-15 rifles. Both subjects told officers they were also wearing concealed handguns. The individuals indicated they were walking to the Downtown Appleton Farm Market and were exercising their right to open carry the AR-15 rifles. They possessed the proper paperwork for the concealed handguns on their persons. After determining the subjects did not intend to harm people and were legally able to possess the aforementioned weapons, the individuals were allowed to leave.





    The Appleton Police Department has no ongoing investigation and considers the issue resolved.

    Looks like the Appleton PD is stepping into it.

    Instead of saying are officers were wrong and we well correct the matter it is the same old.

    We were right.

It scared a lot of people,” [Alderman Curt] Konetzke said. “I have no qualms about what they did. It caused a lot of nervousness — my wife and daughter were at the event, it could have been a disaster.”

    Konetzke said he expects the city to vigorously defend any legal challenge of the detainment. In 2011, the City of Madison paid a $10,000 settlement to a group of gun activists that sued police over a stop at a Culver’s restaurant.

    Appleton police have been tightlipped about the situation that could bring legal challenges.
