I was in class yesterday and a discussion on guns and gun laws came up. We talked about everything imaginable and the last topic we talked about was if you do or do not have to inform an officer of your firearm during things like traffic stops or roadblocks. From my reading and personal experience along with talking to my lawyer and father about this issue I have understood in the State of Mississippi you do not. I have also read on Handgunlaw.us and i believe and on here that it is not required. I know that the few of you I see on here a lot are not lawyers so no need for a disclaimer, but is he correct and somehow many people are missing this law? If so could you please post the law, if not let me know so I can feel more confident that I am understanding the law correctly.

The Ms. Constitution prohibits the regulation of arms not concealed. The answer t0 your question as it relates to OC is no.

Ask your professor to provide the law he's talking about.

Nope

There is no requirement in Mississippi. I have been stopped in roadblocks many times for Operator's License checks with my gun in the glove box, under the seat, or under my shirt with no word from me about the weapon. I have not been checked when actually OCing so that has not come up.

I've been stopped OCing my glock 17 and nothing was said, I don't think the officer saw it but that's why I thought he was full of it. I am counting down the days 2 more months until I can apply for my CC

There is no duty to inform in MS. Cops and the like have a very bad habit of claiming there is a duty to inform in states where there is in fact no such duty.

If a legal requirement to notify existed, it would be fairly easy for the professor to cite the specific code as support for his belief.

If he declines your request to do so while maintaining such an unsupported position, I'd call that an attempt to deliberately misinform.

No, actually American history. We were going over the Constitution and as a class debating and interpreting it. The debate came up due to recent gun control attempts from the left lately. The teacher also claims to be a very conservative republican but when he sleek she SREEMS liberal. Also he seems to think our founding fathers ment we could keep and bear arms for hunting and thinks we should all only own a shotgun or a hunting rifle. As much as I don't want him to get hurt I would like for someone to break into his house as they have my house and tell me how well that .270 did for home defense.

Mississippi Code § 45-9-101 (1) (b) The licensee must carry the license, together with valid identification, at all times in which the licensee is carrying a stun gun, concealed pistol or revolver and must display both the license and proper identification upon demand by a law enforcement officer. There is not a direct link to it.

There is no duty to inform in Mississippi Statutes that I can find. I believe if there were you would not find the section above in the Mississippi Statutes.
