    Question Gov. Brown vetoes 'some' gun control legislation.

    Jerry Brown vetoes some (not all ) gun legislation...

    Brown vetoed the strictest bill, which would have classified any rifle with a removable magazine as an assault weapon, calling it an "infringement on gun owners' rights."

    BUT - ''Brown DID approve a measure to ban kits used to convert standard guns into semi-automatics with large capacity magazines, which he described as closing a loophole in existing state law.'' -caps mine-

    Considering Article IV Section 3 of the United States Constitution (which provides for the creation of new states of the Union), says in part:
    no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.
    It seems unlikely that the CA legislature will allow it to happen.

    Wouldn't that render West Virginia an illegal state, since it was formed out of Virginia during the War of Northern Aggression without their consent?

    Hey, if enough lobbying was done, any part of Cali, or other states, could form their own states. Looking at the history of the U.S., it's been done a couple times before! Kentucky for example, formed from a pawful of Virginian Counties~

    After the people of western Virginia rejected the VA state convention's decision to secede from the Union they formed a new government for the state of Virginia, which President Abraham Lincoln immediately recognized. In 1863 the VA state legislature permitted its western counties to split off and become the state of West Virginia. Congress recognized West Virginia, as did the Supreme Court in Virginia v. West Virginia, 78 U.S. 39 (1871).

    So, the VA legislature did, in fact, approve the creation of WV.

    After Virginia seceded from the Union, it would have been... gauche... to deny the West Virginia counties the right to secede from Virginia.

    However virginia did sue West Virginia after the civil war claiming the state belonged to them and the sesession was unconstitutional. Then virginia later sued claiming West Virginia didn't assume enough of the states outstanding debts when they seceeded....

    West Virginia responded by denying voting rights to anyone who supported the confederate states....

    Well because the ridiculous argument of the feds and the Lincoln appointed justices who kissed the centralist buts by saying secession was illegal then why wouldn't it be illegal for WV? Virginia made a good showing of the hypocrisy of the federal government with those suits.

    It does state that the u.S. constitution is the supreme law of the land.
