Minutes later, Smith called 911 a second time. Cops again told Smith his beef with the store was a civil, not criminal, matter. Smith explained that he had called the emergency line because he “felt Police was not helping him get his penny back from the business.”

Smith then walked across the market’s parking lot and dialed the police non-emergency number and asked for assistance. Cops--who were already at the market in response to Smith’s second 911 call--arrested him for misuse of the 911 system.

Pictured in the above mug shot, Smith was booked into the Shelby County jail on the misdemeanor charge. He was released yesterday after posting $250 bond.

It is unclear whether Smith plans to pursue civil litigation against the Night and Day Food Market. (1 page)

The italic portion: just rubbing salt into a wound, huh?
