Ohio contends that being nice is grounds for search -

    http://www.thenewspaper.com/rlc/docs/2013/oh-polite.pdf

How sweet ... now being nice is grounds for a search.

In Ohio .. where a cop can now just say your speeding and the guberment says "that's all we need"

Now, the appellate court did not agree (neither did lower court).

What kinda a--holes ya have in OH ... to even take this to the appellate court?

So wait, heavy breathing, and overt politeness is RAS for a removal from a vehicle, and a K-9 scent search? Oh well! The ends obviously justifies the means. Besides, criminals don't deserve the same rights that LACs have.

He was, but the court slapped down the cops who made that argument. Sarcasm seems misplaced.

The court and the appellate court got it right.

    Non-event.

Perhaps, but don't you think execution was a little harsh?

It is ordered that a special mandate issue out of this court directing the common
pleas court to carry this judgment into execution.

Wonder if he got his property back?

It is ordered that appellee recover of appellant costs herein taxed.
Of course now they can tax it.

I think the event is that the state actually took it to the appellate court .... maybe a glimpse of how unfair the state thinks the courts are ...

Being overly polite is ... suspicious
Clenching one's buttocks is ... suspicious
Not "cooperating" when asked intrusive questions is ... suspicious
Concealing a weapon is ... suspicious
Not concealing a weapon is ... suspicious
Driving at or below the speed limit is ... suspicious
.. not answered is the question "suspicious of what illegality?"

Anyone else seeing a pattern to all this suspiciousness?

    GTFO then?

I'm glad it was posted. Just because it's what "should be" doesn't mean it isn't "news worthy" (or actually, discussion worthy, as this isn't singularly a news site, only the news subforum is singularly focused on so called "news"). Positive (which this is) needs to be posted as well as the negative, as well as the call-to-arms.

Yep. What's scary is most don't. Or almost as bad, they don't care. The cage is getting smaller.
“If the natural tendencies of mankind are so bad that it is not safe to permit people to be free, how is it that the tendencies of these organizers are always good? Do not the legislators and their appointed agents also belong to the human race? Or do they believe that they themselves are made of a finer clay than the rest of mankind? ” -Bastiat

I don't "need" to openly carry a handgun or own an "assault weapon" any more than Rosa Parks needed a seat on the bus.

So they pulled a citizen out of his vehicle and kidnapped him for the safety of the K9 officer and K9 dog?

Now admittedly the police found a gun and some weed so the kidnapping looks justified, however what about on the occasions when nothing is found in the vehicle and the citizen is detained and treated like a criminal simply for " being respectful or in the words of the kidnappers " acting to nice"

The actions of the state are clearly a joke and the two officers, oh well , they simply thought they were doing some good police work.

Good ruling by the appeals court.

    Best regards

Still not that great of a decision, they keep perpetuating bad precedents.

Cops can run havoc over your rights as long as they do it quickly.
I am not anti Cop I am just pro Citizen.

    U.S. v. Minker, 350 US 179, at page 187
"Because of what appears to be a lawful command on the surface, many citizens, because
of their respect for what only appears to be a law, are cunningly coerced into waiving their
    rights, due to ignorance." (Paraphrased)
