    NY Gun "Confiscation"

    So we've been hearing alot of the gun "confiscation" that has been occuring that is about to occur in NY. I checked and didn't see a separate thread for this, just it being discussed in numerous other threads. So far I've been able to gather that the "confiscation" and letter that's been sent out in in regards to Rifle and Shotgun that holds more then 5 rounds. This was in regards to a law that was passed a few years ago, NOT THE SAFE ACT. There seems to bw quiet a few different "theories" about this confiscation. I'll attempt to add what I've found and cite the sources.

    First, The blaze is reporting that part of this has to do with 1 guy that had a letter sent to him because he was on some psych meds or treatment :

    The Case:

    On April 1st, a legal gun owner in upstate New York reportedly received an official notice from the state ordering him to surrender any and all weapons to his local police department. The note said that the person’s permit to own a gun in New York was being suspended as well. The gun owner contacted attorney Jim Tresmond (a specialist in gun laws in New York) and the two visited the local police precinct.

    Mr. Tresmond reportedly went into the precinct and informed the officers that his client, waiting in the parking lot, was coming in to voluntarily surrender his weapons as requested. The local police were aware of the letter because they had already been contacted by the State Police. Apparently, if people do not respond to the initial mailing, local law enforcement is authorized to visit the gun owner at their home and demand the surrender of the firearms. In this case, the gun owner followed the request as written. The guns and permits were handed over and a receipt given to the client.

    That one DOESN'T appear to be about the letter that was posted, but this case has been in the mix with the confiscation.

    This is the thread that someone started about the letter. You can see a copy of said letter in the post. There is one Officer? (maybe?) that may or may not work for NYPD and is alleging its a hoax. He explained the letter on the internet is a modified copy. Not sure what proof they have, but these guys were discussing that the letter looks "suspect" due to a few things with its apperance. Again, this appears to be based on New York City Administrative Code 10-306(b) that was passed a few years ago. Apparantely they may have just started trying to enforce this section?

    Finally, about the safe act... This is the letter that was sent to gun owners in regards to the "confiscation" of firearms..... there isn't one. This letter states if you fail to comply with it they will suspend your license. Could that defacto lead to them getting a warrant and securing them? Maybe. But as of now, they are not threatening to kick their doors down...

    So, it appears there is one guy who had his pistol permit yanked due to medical reasons (The blaze). There is a older law that states that anything over 5 rounds is no good in shotguns or rifles, and they may or may not be decidind to enforce that now (NYCAC 10-306(b)), which is the letter that was posted (maybe?) And finally, there is the Safe Act, which starts the ban on anything other 7 rds (pistol).

    If anything is wrong on here, I'm open for correction. Do not take this as complete source and compliation of "facts" with this ongoing issue. I just figured we needed a jumping point for anyone who was interested in the story. If anyone else has a better grasp of it please post and help us clear this up.

    I've read THAT 500 letters known to have been sent out to people....that's all I know...

    Thanks for the sanity check. Firearms freedoms in NY obviously are in a really bad state but it is important to try to determine what is fact and what is unverified/sensationalized.

    Antis are trying to say that this has been on the books for a while.

    Yet only now are they trying to enforce it....they have no proof that people have these guns in the city right now.

    But yet they send out these offensive letters basically accusing people of being criminals.

    Do they send out letters to people who move to come down to the police station and show them new voter's registration cards?

    Not just antis. I'm telling you what I researched and found. 10-306(b) as quoted has been on the books for a while. Why are they enforcing KT now? No idea good question.

    Their proof is they have a gun registry of anyone who buys firearms. The example letter shows how they have a make model and serial of firearms and list the ones that are in violation. I'm certain there are plenty that are not "on the books".

    Also part of the new safe act requires a registration of all firearms purchased even private party except family members an I'm assuming since these firearms are banned they won't be available for transfer or purchase through the ffl.

    Finally as far as the "500 letters" I agree its been reported numerous sources but again not substantiated at any source to include Fox. They just keep showing the same 1 letter that's on the internet and saying there is 499 more out there. No one else has come forward yet with any other examples. Hence the skepticism of some to include myself.

    Again not saying I agree in anyway just trying to clarify what's out there so far.
