The freedom of information commission clearly does not want to hear the argument that since PA13-3 requires us to register, and this was upheld at a lower court, that PA13-3 is basically saying that registration does not equate to a safety risk ... and therefore, the arms that state agencies (or records thereof) should be available to the public (opposite of what DESPP says).
The commission decided not to hear the case ... but they have to, its a record request appeal.
So off to superior court seeking an order for the commission to hear the case. I'm confident of a win.
Sooner or later a court is going to have to rule that registration or disclosure of firearms either a) creates a safety risk or b) does not
If its (a) .. then PA13-3 registration requirements can be attacked as being an infringement. After all, a safety risk = risk of death.
