Guy fires warning shots -- gets arrested

I am all in favor of warnings, NOT warning shots. "Back off I have gun" is enough, if that does not work "bang" into the threat.

But NYCPD fires warning shots and are not charged even though they hit innocent bystanders. They have to be warning shots, who could miss that many times.
