An investigation that began back in April determined that Officer Jeremy Dear’s camera was intentionally disabled right before he shot and killed Mary Hawkes, 19. Now, Albuquerque Police Chief Eden has fired Officer Dear, as part of what is being called a “zero tolerance” policy on police camera use during citizen interactions.

"This case shows why it won't."

It doesn't follow. Destroying a citizen's video evidence is tantamount to admission of guilt. If the courts don't care to recognize that, we can always use the legislature.

The posting was in respect to the cop turning off HIS camera ... not a citizen's ... (4 clarification)

Time line of a sort.
Albuquerque police on Wednesday confirmed that lapel camera technicians were unable to retrieve video from the officer who shot 19-year-old Mary Hawkes last month after a foot chase, but they did release new videos taken after her shooting death.

Then...
Albuquerque, NM- The Albuquerque Police Department is under scrutiny again after an investigation of APD officer Jeremy Dear revealed that his body camera malfunctioned for a third time while on duty. During his camera’s latest malfunction in April 2014, Dear shot a 19-year-old woman who was on the run after being suspected of driving a stolen truck.

Then the coup de grâce!
Albuquerque police officer Jeremy Dear, who fatally shot a 19-year-old woman suspected of stealing a truck in April, was fired Monday for insubordination and untruthfulness, according to Albuquerque Police Department Chief Gorden Eden.

It is not entirely clear at this point that Ofr. Dear will not get his job back if it can be found that his lawyer's allegations re the department are true. Note that Taser Intl. could not determine if the camera system had been turned off or failed.
