South Dakota: Permitless Carry Legislation Introduced

Yesterday, a bill recognizing South Dakota's freedom to legally carry a concealed firearm without the burdensome requirement of acquiring a concealed pistol permit was introduced in the House of Representatives. Authored by Representative Jim Stalzer (R-11), House Bill 1116 is an important reform to current South Dakota law.

HB 1116 is a necessary update to concealed carry statutes in South Dakota, allowing law-abiding gun owners the ability to protect themselves and their loved ones. In South Dakota, it is already legal to carry a firearm openly, as long as the individual is not prohibited by law from possessing a firearm. However, under current law, if a firearm becomes covered by a coat or if a woman prefers to carry a firearm for self-protection in her purse, one would need to possess a concealed pistol permit.

This permitless carry legislation gives South Dakotans the freedom to choose the best method of carrying for them, based on their attire, gender and/or physical attributes. However, this legislation would also keep in place the current permitting system so that people who obtain a permit could still enjoy the reciprocity agreements that South Dakota has with other states.

It appears that we may have a natural progression of moving from no permits or discriminatory issue permits, to shall issue permits, and now toward permit-free or constitutional carry. Along the way, I think we're also seeing a trend toward reducing off limits locations providing some protections to employees against anti-gun employment policies, and toward greater legal respect for the right to actually use force in self-defense.

I don't see even one Democrat in that list of cosponsors. Can this bill pass without them?even

South Dakota; House members---58 Republicans 12 Democraps
Senate members--27 Republicans 8 Democraps

Yeah, I think they have a shot at passing the bill.

This morning, the South Dakota House State Affairs Committee heard and passed HB 1116, NRA-backed permitless carry legislation, by a 7-5 vote. Authored by Rep. Jim Stalzer (R-11), the bill respects your right to legally carry a concealed firearm without the burdensome requirement of acquiring a concealed pistol permit.

Would that it be that easy. This was just a committee vote and not by an overwhelming majority.

Wish to anticipate the best with the R v. D ratio in the senate.

The house has 70 members, 58 of which are Republicans. In the Senate, there are 27 Republicans and 8 Democrats, a bit tighter ratio. The Governor, Dennis Daugaard, has been in office since 2011.

Wouldn't we all?

Not too long ago Gov. Daugaard signed a bill allowing handguns in classrooms under some circumstances/conditions.

Yet he vetoed a similar "permitless carry" bill in 2012.

I'm receiving mixed signals from this gov - he seems to straddle the fence. Thought maybe someone local might have some insight.
