Border Patrol now stopping cars in Upstate NY

I guess they're looking for Terrorists (probably not concerned about Illegals 'expressing their love') coming across the border. Similar to thread in past on this in South Texas and Arizona. Of course my question is, what is ICE then doing? Once they determine you're an illegal, they probably give you $5000, sign you up to vote, welfare & medicaid, and put you in touch with someone to file your 3 years of tax returns to get another $20k. The rest of you pesky citizens get the hell out of here, after we search your car for any guns, drugs or other things we would like to keep.

DHS is just using 1976 SCOTUS ruling on Immigration to expand and do drug searches, contrary 2000 SCOTUS City of Indianapolis v Edmond where DEA stops were violation of 4A.

That ACLU map is widely reported, but isn't accurate. The border isn't the U.S. shoreline of the Great Lakes, for example -- Chicago isn't actually within the 100 mile zone.

As to the OP, this isn't a new development. USBP have been following --err, pushing the limits of-- case law for quite some time. All of the interior checkpoints exceed their authority (to inquire about citizenship), and instead look for excuses to search vehicles and/or delay them for dog searches. In light of the recent SCOTUS ruling that police may not delay a traffic stop to allow for a dog search, it will be interesting to see what happens.

In New Hampshire, we have seen abuses of the "roving patrol" standard, which requires the same standard as any traffic stop (even though USBP are not recognized as LEOs with any authority to conduct such stops in this state). In one case, they stopped a driver who had just legally passed through USBP's permanent point of entry from Canada, on the same highway, within 20 miles, and proceeded to treat him as a felon in front of his young son, while they were in the middle of an "epic father-son road trip".

I dont think all the 9/11 guys came across the northern border. want to say they overstayed their visas and they Feds should have caught them. Dumb-a conflates Immigration w DEA duties. I guess you passed immigration so DEA wants a 2nd bite. Scotus seemed to say DEA can stop you w/o probably cause. Did hear the 'you look nervous' quote from the jerk. Wonder if you just said - what is probable cause for stop - no reason for detention.

All but one of the hijackers presented visitor visas that immigration inspectors used to decide whether to admit them as tourists or on business. All but two of the nonpilots were admitted as tourists and were granted automatic six-month stays. This allowed them to maintain a legal immigration status through the end of the operation. One of the two nonpilots admitted on business was granted a one-month stay; he, along with another of the nonpilot operatives, was in violation of immigration law for months before the attack.

The one pilot who came in on a student visa never showed up for school, thereby violating the terms of his U.S. visa. Another of the pilots came in on a tourist visa yet began flight school immediately, also violating the terms of his U.S. visa. This pilot came in a total of seven times on a tourist visa while in school. In both cases, the pilots violated the law after their entry into the United States.
