    Open carry news piece out of Lake Charles

    I came across a news article regarding open carry and its restrictions. The article originated on a Lake Charles television station and included a video interview of the Sheriff. During the interview the sheriff indicated law enforcement could stop an individual who is open carrying his or her sidearm and asked them for an ID. In my opinion this information is both erroneous and troubling. There is still something in the state of Louisiana called probable cause. An individual exercising his right is not subject to a random stop by a law enforcement officer without probable cause. My question is does anyone else see this the same way? Or, am I missing something in the statutes that gives law enforcement such a right without probable cause.

    Open Carry alone is NOT Reasonable Articulable Suspicion (or RAS) as required by law to stop and detain someone who is not then or reasonably suspected of committing an unlawful act. The other thing wrong was that the reporter stated that background checks were required when buying a gun. That only applies to FFL (Federal Firearm Licensed) dealers, NOT individuals. Also, a business has to either have some sort of "No Guns" signage to forbid you entry OR they have to ask you to leave. Calling the cops without either of those is NOT legal grounds for a trespassing charge. The Most a cop can do LEGALLY at that point is ask you to leave. If you are ever asked to leave a business by someone who works there, LEAVE, RIGHT THEN. This is NOT the time to argue with them! Areas that you are also prohibited from Openly Carrying include but are not limited to: Places that serve alcohol for on site consumption including restaurants; Post offices; Polling stations; the secure areas of airports and Veterans Affairs Hospital buildings AND Grounds.
