    Mainer Who Shot Intruder Sues Landlord to Keep Gun

    A disabled former lobsterman who shot an intruder after buying a gun to defend himself sued his landlord Monday over a policy that prohibits him from keeping a gun in his subsidized apartment.

    Harvey Lembo, who uses a motorized wheelchair, was warned by his property management company that tenants are prohibited from having firearms after he shot an alleged burglar in the shoulder after five break-ins.

    Short version... The 67-year-old wheelchair bound Lembo, a retired lobsterman and former Vinalhaven volunteer police officer, has survived three heart attacks and suffers from diabetes and degenerative heart disease, and he feared that he was being targeted by burglars for prescription medication used for chronic pain, according to the lawsuit. He has been burglarized 4 times prior to the 5th time which happened 12 hours after he finally and lawfully purchased a firearm.

    This is a prime example of why I have filed a lawsuit in federal court in Tacoma Washington against the my former landlord for evicting me from my subsidized apartment.

    I don't believe that this topic should be in the Maine state forums. This issue has significant national ramifications as it involves federally funded subsidized housing.
    Armed and annoyingly well informed!

    You're right about the significant ramifications. Here in Maine, this situation isn't settled law.

    > Maine Supreme Court ruled (6-0) in 1995 that Public Housing must adhere to Law governing firearms, which means allowing them for any who can legally possess.
    > Complete private housing must universally include firearm clause in leases or in a universal policy (everyone or no one); if done, then enforceable. No policy or no clause, not enforceable.
    > Partially private/partially subsidized hasn't been settled yet. Hopefully Mr. Lembo will be willing to walk it up through the Courts.

    In my mind and the way many cases have been settled, you take public money, you must adhere to the Law, no special dispensation or clause creation; you get public monies, then you must allow for any who can legally posses.

    Maybe you, and the others who live in subsidized homes, should apply yourselves into getting better jobs, and getting off the government's teat, so you can eventually own your own home, and set your own rules, and not mooch of our tax dollars. [Sarcasm based on typical Republican mantra].

    Some of us are permanently disabled and unable to work at all. I am one of those people. The person in the above news article is definitively disabled and unable to work. Trust me, I would love to work but I can't due to no fault of my own. And yes, I do notice the sarcasm.

    Of course, there is a good chance this old man would pass any drug tests and disability verifications while receiving said subsidies, which in themselves are not bad.

    I don't care if people put narcotics and other drugs into their body ... its their body and they can do what they want with it.

    Portugal eliminated all drug laws and they are doing just fine.

    I think that by putting folks in prison, this is almost guaranteed.
