Mapping How Guns Get Around Despite Background Check Laws

Gun-control advocates often cite that 40 percent of guns have been obtained by people without a background check. That stat is often attacked, however, for being produced from a small sample size of survey respondents (251) and published in an aged report from the early 1990s. The federal Bureau of Alcohol, Tobacco, and Firearms (ATF) doesn’t do the best job of tracking gun figures like this, but Harvard University researchers have.

In an interview with The Trace, Harvard Injury Control Research Center director Deborah Azrael confirmed the 40 percent figure in terms of people who’ve acquired guns without a background check. This number is based on her team’s survey of more than 2,000 gun owners for a forthcoming study. Some preliminary data released to The Trace provides context for this new 40 percent stat:

  • Roughly 30 percent: Gun owners who did not purchase their most recent gun, instead obtaining it through a transfer (a gift, an inheritance, a swap between friends).
  • Roughly 70 percent: Gun owners who purchased their most recent gun.
  • Among the gun buyers, about 34 percent did not go through a background check.
  • Among the gun owners who got their firearms through a transfer, roughly two-thirds did not go through a background check.

Yep - manditory background checks (including father to son at the range) would stop criminals dead in their tracks = no approval, no BGs w/guns, right?

These studies imply that there are plenty of dealers/FFLs who do not do their job. That just isn't the case.

Seems it would be better to require background checks when transfering possession of a vehicle. Surely that would stop BGs from moving from point A to point B with such ease.

I just wish someone would interview a bunch of criminals who were convicted of gun-related charges and ask them one question: did you go through a background check to obtain the firearm you used in your crime? Then publish the results so we can use them in our arguments.

Actually, getting a gun from a family member or friend is the most reliable form of a "background check." But we'll ignore that because it doesn't bring revenue or allow the government any kind of registration or control.

When you apply to work for the FBI, what do they do AFTER Googling your name through their system? When they want to be sure? They interview your family and friends!

Silence! We'll have none of those reasonable suggestions here. Those who wish Ban All Offending Things would call the study biased, hateful, racist, and probably make up a few things to hashtag about as well.

Add: Since the VAST majority of lawful gun owners desire that guns stay out of the wrong hands, there are very few accounts of private sales from the law-abiding to the criminal element.
This is an excellent point, and should be spread far and wide in all media outlets! Many Letters to the Editor allow for comments, this is a great one to add to the dialog!

+1 to Mac702's observation about how real background checks are conducted: interviewing family and friends.

Until being denied a purchase on a background check reliably results in arrest, prosecution, conviction, and incarceration for trying to illegally buy a gun, background checks don't deny BGs guns. They just force BGs to buy guns through other means. Kind of like where they buy drugs, prostitutes, and other prohibited items.

It is a tiny percentage of denied purchasers who are ever prosecuted. Most are denied wrongly. Even among the real criminals who the courts have deemed safe enough to walk our streets unsupervised but not safe enough to exercise fundamental rights, VERY few are ever prosecuted at the point of trying to buy a gun illegally.

If 40% of folks get their guns w/o a BR check then I think it evidences that BR checks are not needed at all.

Its not Armageddon out der.
