    Traveling From NC to VA OC Questions...

    Hi, I have been traveling back and forth from NC to VA for the past couple years. I do currently have a NC CHP and have carried concealed in my visits to VA, and of course, I will not be able to do this legally after 2/1. For the first time in my life, I will open carry while in VA. Funny, to get my NC CHP I had to go through bg checks and be fingerprinted as well. I am new to this so I will have alot of questions.

    1.) What do I need to carry with me to OC in VA, besides my driver's license and gun?

    2.) Will I need proof of ownership of the gun as well? Don't know what that would be since I purchased my firearms many years ago, and do not still have bill of sales.

    3.) Can I legally OC in VA, have my gun in a IWB, and not cover with my shirt? If so, does anyone recommend a good IWB holster with good retention?

    Thanks for the answers, I am a bit frustrated on being labeled a criminal if I conceal in VA after 2/1.

    Doubt you can ask one which hasn't come up before.

    1 -In the Commonwealth of Virginia, open carry of a handgun is legal because there is no statute forbidding it, no restriction on OCing in a vehicle either.

    2 - No proof of ownership, no registration. You can carry a borrowed gun.

    3 - OC in whatever style holster works best for you OWB, IWB, et al - the test is whether the gun can be easily identifiable as such and not be of a deceptive nature i.e. belt buckle gun which would require a permit.

    Local ordinances cannot restrict how one carries. - we enjoy a rather meaningful state preemption. Just the carry of a gun is neither PC for a stop, nor RAS of a crime. You can OC in an establishment that sells adult beverages ...and drink, though many of us here discourage imbibing.

    Here is a pictorial example of the "Virginia Tuck" (even though it's on a Nevada page) about 2/3 down the page.

    And here is my favorite IWB/OWB holster - I own one (in black) for every gun I carry.

    I haz a major disappoint that nobody has bothered to warn rfd about the Governor's new executive order in re executive branch facilities, and how that means among other things that Visitor Centers/rest stops are now off limits.

    While the law against indecent exposure http://law.lis.virginia.gov/vacode/t...ction18.2-387/ still only makes an exception for breast feeding I seem to recall a court case decision that "unintentional exposure" while making an emergency rest stop on the side of the highway was found not to be a violation because it did not meet the "intentional" requirement.

    18.2-387. Indecent exposure.
    Every person who intentionally makes an obscene display or exposure of his person, or the private parts thereof, in any public place, or in any place where others are present, or procures another to so expose himself, shall be guilty of a Class 1 misdemeanor. No person shall be deemed to be in violation of this section for breastfeeding a child in any public place or any place where others are present.

    Welcome [back] to Virginia

    I also travel to North Carolina from time to time since my son moved there. He lives in Durham and when we go to visit him I'd carry concealed or openly, depending on the weather. I am attempt to present myself as one of those pesky (but necessary) tourists at least twice a year down in the Outer Banks. I always enjoy my time in NC.

    I would like to offer you my apology for our foul politicians that are lapdogs for the anti-freedom crowd. They will tearfully insist that they are disarming you for your own good to increase you security. We both know that is balderdash. Actually they know it too since they insist on being surrounded by tax funded ARMED body guards.

    As pointed out by other posters, you may consider just defaulting to open carry. I open carry almost all the time and have been doing so for years with no issues. When open carrying one does not need any "papers", heck, some even do what they call "sterile carry", which is no ID, no driver's license, no social security card, no note from Mommy, no nothing!!! (sorry 'bout that grammar). I don't do that myself since I always have my wallet. I never know when I might need some fiat currency in case of an emergency such as a ammo sale, or the "hot doughnuts" light comes on at Krispy Kreme.

    At any rate, I hope you enjoy your time here in the Old Dominion and that you don't have any hassles here. I would like to encourage you to go to www.vcdl.org and sign up for our VA Alert email. that will keep you up to date on all the crass conduct of our elected vermin in Richmond. We don't sell, trade, share, or otherwise disclose your email to any other group or .org. And, we don't pester you for money all the time either. And we don't try to sell you time shares, viagra, life insurance, etc.
