    It will be interesting to see whether the district court adopts the recommendation; if so, then I expect this case to be quite important in this area of Second Amendment litigation.

    IV. CONCLUSION AND RECOMMENDATION
    For the reasons set forth herein, I RESPECTFULLY RECOMMEND that the motion (Doc. No. 17) by defendant Arlyn DaleJohnson to dismiss the indictment be denied.

    I would think that once released, this is prima facia evidence that the person poses no threat to society (otherwise, why is the person being released?)...hence there are no laws needed for these dangerous individuals as they should be "locked" (for lack of a better term) away.
