    2016: Sb97 concealed firearms amendments

    Sen. Hinkins, David P, is sponsoring SB97 CONCEALED FIREARMS AMENDMENTS.

    This bill appears to have two effects:

    1-For a person 21 years of age or older who may legally possess a firearm, the firearm could be legally carried concealed without needing a permit...so long as the firearm was what we call "Utah unloaded" (no round in the chamber, but full magazine ok).

    2-Cleans up some redundant language regarding non-residents traveling through the State with guns unloaded and securely encased.

    From a quick initial reading, this bill looks to be a "No permit needed to wear a jacket" bill. It would allow someone at least 21 years old to carry a firearm under a jacket on equal terms as he may currently OC: no permit needed if the gun isn't loaded.

    I believe this is essentially the same bill that Herbert has vetoed two years ago and threated to veto last year. This being an election year for our governor, and he facing an intra-party challenge....

    But its a trap ... how many carriers have had cops say that the were OCing when they were CCing?

    What trap? And zero.

    OC is legal in Utah. We have no laws against printing or other exposure while carrying pursuant to a permit.

    Before shooting your mouth off, at least understand the laws of the jurisdiction being discussed.

    Phone calls needed

    We've identified Gov. Herbert as the main roadblock to preventing any progress on permit-free concealed carry this year.

    Please take a moment to contact Gov. Gary Herbert and ask him to support SB97, Sen. Hinkins’ Constitutional Carry bill with no anti-gun amendments. This bill is being held up in the Senate Rules Committee, and we are told that the main reason is because the Governor has threatened to veto it.

    No round in the chamber? How would that work carrying a revolver?

    First, the word chamber is not used in the Utah code.

    A revolver is deemed loaded when there is an unexpended cartridge in the firing position or when the manual operation of any mechanism once would cause an unexpended cartridge to fire. So for a double action revolver, unloaded is hammer down on an empty cylinder and the next cylinder up.
