    Apparently, Gov. Tomblin is expected to veto it like he did a similar bill last year.

    Except this time there's plenty of time for a veto override. I think he has until Thursday or else it becomes law automatically.

    The West Virginia Constitutional carry bill, HB 4145, has passed both the House and the Senate by wide, veto proof margins. The House, 68-31, the Senate, 24-9. The bill went to Governor Tomblin on the 26th of February. According to West Virginia law, Governor Tomblin has five days to sign or veto the bill.

    Last year, 2015, he did not receive the Constitutional carry bill until the last day of the session. He was able to veto Constitutional carry after the legislature had adjourned, ensuring that his veto would not be overridden.

    This year, 2016, Constitutional carry was passed with enough time for a veto override if necessary. If Governor Tomblin signs the bill, it becomes law; if he does nothing, it becomes law after five days. If he vetoes the bill within the five day period, the West Virginia legislature can override his veto with simple majorities in both houses. From wv.us:

    Fingers crossed and waiting with baited breath that WVA will be the next state to have Constitutional Carry. That would be an eagle feather in that state's bonnet and put pressure on other state governments to do likewise, including particularly the VA General Assembly.

    I see this as a growing ground swell - state after state embracing ConCarry. I much prefer this methodology as opposed to an attempt at passing such a federal law.

    I agree and feel the groundswell too,, I also prefer to keep the fed out of constitutional carry rights!

    Indeed I should have said "bated" breath as a contraction of abated. That said we are in the process of changing the language definitions again.

    I will be a happy camper if it passes. I was quite disheartened when the governor vetoed it last year.

    I believe today is the day for the governor to poop or get off the pot. Personally, I hope he just does.... nothing. Then it becomes law automatically.

    1.So what is the process in West Virginia for a veto override?

    2.When does it take place?

    3.How long is the process?

    4.What time frame do they have to get it done by?

    5.And when they override the veto, when does the law take effect?

    After a bill passes both chambers in the same form, it is sent to the governor. While the Legislature is in session, the governor has five days to approve or veto a bill he or she receives. After the Legislature adjourns, the governor has 15 days to act on most bills. However, the budget bill and supplemental appropriations bills must be acted upon by the governor within five days regardless of when they are received. If the governor does not act within these time limits, bills automatically become law without his or her signature.

    Overriding a Veto

    If the Legislature is still in session when the governor vetoes a bill, a simple majority vote of the members of both legislative bodies is necessary to override the veto. In cases when a budget bill or supplemental appropriation bill is vetoed, a two-thirds vote of the members of both houses is needed to override the veto.

    The West Virgina Legislature has until 12 March to override Governor Tomblin's veto. That is six working days from now. The bill passed with overwhelming support. 68-31 in the House, 24-9 in the Senate. Now we will see if the legislators really meant it when they voteed for Constitutional carry.

    House overrides Tomblin veto, WV moves toward permitless concealed guns

    The state Senate will likely follow suit on Saturday morning.

    “We’ll plan on addressing that tomorrow,” Senate Majority Leader Mitch Carmichael, R-Jackson, said. “Those who have voted for the bill have expressed a desire to stick with their votes to move forward on a veto override.”

    The bill (HB 4145) originally passed the Senate 24-9. It takes only a simple majority to override a veto.

    The bill would take effect in late May.

    The West Virginia legislature did not waste any time in overriding Governor Tomblin's veto of HB 4145, also known as "Constitutional carry" or permitless carry. Governor Tomblin vetoed a similar bill in 2015, but the veto occurred after the legislature had adjourned, making a veto override difficult.

    This year, the Constitutional carry bill was passed early enough for the legislature to vote on a veto override if necessary. Governor Tomblin received the Constitutional carry bill on 26 February. He waited to the last possible day to veto it, 3 March. The House of Delegates overrode his veto on 4 March, and the Senate completed the override on 5 March. From state.wv.us
