Covered holsters

I wanted to know no if a holster that completely covers the weapon is considered openly carrying or concealed carrying. I thought it might be useful to have some such holster for days with inclement weather.

My opinion, that is concealed. Va code defintion:

'a weapon shall be deemed to be hidden from common observation when it is observable but is of such deceptive appearance as to disguise the weapon's true nature.'

Might be walking a thin line. However, if you are not in a drinking establishment, no fuss, no muss. Then again if enough grip is sticking out...... ah! what do i know.....

I would suggest that a gun carried in such a holster would be technically "concealed".This rather underlines the value of a permit to carry concealed, IMHO.In theory, one then ought to be able to "go both ways", so to speak, without problems!

Just my opinion, probably worth what you paid me for it!

I think a military style flap holster can be reasonably considered OC. However YMMV but looking at all the hunting pistol holsters that are available, if it could have been considered CCW I think a case would have shown up. I would think a game warden comewhere would have snagged someone for it. As long as the holster conforms with the shape of weapon and carried like one would carry a weapon, I think you would be ok. On the other hand if a flap holster is CCW, then that could offer people in say Florida and Texas a method of psuedo open carry.

This thread needs more pics. I can see Truebrits point, and from looking at different types of flap holsters some are not what I would consider open carry. The squarish Safepacker is definitely not open carry. It is more akin to a fanny pack holster, openly carried but not obvious to its contents. Perhaps even the Blackhawk special operations thigh holster with the flap closed. I think the Bianchi military flap holster is obviously carrying a pistol. Also I think there is a historical precident in favor of flap holsters being that theywere among the first wide scale production styles of holsters.

On a side note if one were to want to carry psuedo openly or at least OWBin a place like Texas or Florida, I think the Safepacker might be a way to go.

Just trying to figure out how one could get hung up on a concealed weapons charge with a flap holster. I don't think a charge would get very far. I can imagine a trial going like this.
Judge: How did you know the defendant had a concealed weapon?
Officer: I saw his holster on his side.
Judge: Was his holster hidden at all?
Officer: No.
Judge: You mean to tell me you saw a holster with a gun in it and you arrested a man for concealed carry of a weapon? Nevermind, case dismissed.

Or so I would hope.

You know, sometimes I think y'all are reading my mind. I was contemplating buying a holster with a cover flap, googled for it and in addition to finding the "Safepacker" I found you guys already talking about it. (Putting on his tin foil hat.)

I'd certainly be interested to hear more information on the legaldefinitions of "concealled" and how this kind of holster might apply to legal concealment. If anything, it will be more fodder for the socialists here in California to say. "There ought to be a law..."

Could this go the other way around? In a non-OC state (Florida), could I walk around carrying a gun-shaped, covered holster, and would that still be concealed carry?

Fanny packs are a popular way of carrying a concealed weapon; if that fanny pack happened to be shaped in a certain way reminiscent of a firearm, who can help that? And besides, what if I did wear a holster, got stopped, searched, and the officer found tiny pinecones inside? I couldn't be arrested for that.

You could be arrested for anything, including doing nothing, you could beat the rap probably. People have been arrested carrying empty holsters, it alldepends on where you are and the legal status of open carry. I think concealed carry hinges on the disguising the weapons true nature. Hence why fanny packs and belt buckles have been considered CCW.
