What state? Indiana? I think so - very few states prohibit carriage of loaded rifles about town on foot, or require any permit to do so.

It's an interesting story, but not really an OC story. He grabbed the rifle and went outside when he heard trouble; he didn't pick it up until after incident began.

The article mentions that damage of your fence is not an excuse for deadly force. But an unknownvehicle driving through a fence onto your yard in the middle of the night sounds like the kind of trouble that might warrent arming one's self.
