The preemption bill has been law since 1985, now is the time to correct this statue.

Well here is her first response:

Ms. Keller,

I just got done reading your article “Bill would end
bans on carrying guns openly”. The state passed the
preemption statue in 1985 and gave counties and cities
the ability to regulate “weapons readily capable of
lethal use”. The city of Cape Girardeau and others
throughout the state have taken away the rights of
citizens to bear arms in defense of themselves.

Carl Kinnison took the same oath of office I did. We
are to protect and defend the constitution of this
state. Here is what the Missouri Supreme Court had to
say about article 1 section 23 of the Missouri
Constitution. In State v. Wilforth, the court stated:
We do not desire to be understood as maintaining
that in regulating the manner of bearing arms the
authority of the legislature has no other limit than
its own discretion. A statute which, under the
pretense of regulating, amounts to a destruction of
the right, or which requires arms to be so borne as to
render them wholly useless for purposes of defense,
would be clearly unconstitutional.

Then again in State v. White, the court stated: The
evident purpose of section 17, art. 2, is to render
the citizen secure in his home, his person, and his
property. Its purpose is to deny to the Legislature
the power to take away the right of the citizen to
resist aggression, force, and wrong at the hands of
another. By no possible construction can that section
of the Constitution be held to guarantee to the
citizen the right to keep and bear arms for the
purpose of his own aggression, wrong, or assault upon
the person or property of another. The right of the
citizen to keep and bear arms for his own protection
or in aid of the civil power, when thereto legally
summoned, is the only right guaranteed to the citizen.

Senator Jason Crowell should be commended for putting
forth this much needed piece of legislation. Somebody
open carrying in the City of Jackson, should not
become a criminal because they crossed the city limits
of Cape Girardeau.

I look forward to your next informed article on the
rights our citizens enjoy here in Missouri.

Personally I would have no problem with the passage of the open carry law, and honestly think it is a good Idea, and recognize fully that there would be restrictions on it as with everything else, maybe it would be an option that if a person wanted to carry openly they would have to pass the same conditions as Concealed Carry but with the option of open carry, that would put a damper on those that would say that there would be no control on the people that decide to carry openly, even though if a person is 21 years of age they can carry a concealed weapon it the passenger compartment of their auto with no restrictions or training and that does worry me a bit, open or concealed carry just don't bother me one way or the other.

Hearings are being held on this bill, the Castle Doctrine bill, and the bill to repeal the Permit to Aquire a Concealable Handgun in the Senate Lounge as I type this, 1900hr on 2/12/07. Hopefully all three will pass quickly from committee and be enacted on the floor of the Senate.

A friend of mine (Shawn Cassidy) was at the Senate hearing last night and testified in favor of the Castle Doctrine, Firearms Preemption, and revocation of the PTA. He said it was a great meeting and the committee was very responsive to those testifying.

Had I not been to Jefferson City twice in the last two weeks, I would have been there myself (I live in Cape Girardeau and it is a four hour drive to JC).

I am especially interested in SB 217 allowing full state firearms preemption. This is a pet project of Shawn and myself. We contacted Senator Crowell (R-Cape Girardeau) several months ago about introducing legislation and provided him with hours of research justifying the need for this very important bill. Hopefully all the firearms related bills will move forward out of committee to be debated on the Senate floor.

The SB 217 bill only had two or three people spoke to support it, although they could have been representing groups. The NRA left the room when it came up and they told one senator that they supported the NICS check. I told the committee that ANY prior restraint on a constitutional right...is unconstitutional. Senator Crowell (R-Cape Girardeau), stated he was willing to work with the committee on wording having to do with the discharge of firearms..I advised the panel to bring the law in compliance with Chapter 563 RSMo.

This was a very good night for us...plus I got to meet some great individuals, such as, Kevin Jamison, Tom Oliver and Sheila Stokes-Begley (WMSA Pres.) All really nice and pleasant to talk with.
