    OCONOMOWOC, Wis. - A man said he broke into an apartment with a cavalry sword because he thought he heard a woman being raped, but the sound actually was from a pornographic movie his upstairs neighbor was watching.

    “Now I feel stupid,” said James Van Iveren, who has been charged in the case. “This really is nothing, nothing but a mistake.”

    According to a criminal complaint, the neighbor told police that Van Iveren pounded on the door and kicked it open without warning Feb. 12, damaging the frame and lock.

    “Where is she?” Van Iveren demanded, thrusting the sword at the neighbor, the complaint said. “Where is she?”

    The neighbor told police Van Iveren became increasingly aggressive as he repeated the question, insisting that he had heard a woman being raped. The complaint said that, with the sword pointed at him, the neighbor led Van Iveren throughout the apartment, opening closet doors to prove he was alone.

    The neighbor later played for police the part of the DVD he believed Van Iveren heard downstairs.

    Van Iveren, 39, of Oconomowoc, was charged with criminal trespass, criminal damage and disorderly conduct, all while using a dangerous weapon, and is due in court March 5. Together, the misdemeanor counts carry a maximum sentence of 33 months in jail.

    Van Iveren said Tuesday that he heard a woman “screaming for help,” grabbed the sword, bounded up the stairs, kicked in the apartment door and confronted the man who lived there.

    “I intended to hold it behind my back and knock. But I froze and instead, what happened happened,” he told the Milwaukee Journal Sentinel.

    Contesting his neighbor’s account, Van Iveren said he didn’t look anywhere in the apartment except the front room, and that he never threatened the neighbor with the sword.

    “I had the sword extended. But that was all,” he said.

    Van Iveren, who lives with his mother in the downstairs apartment, said he did not call police when he heard the noises because he does not have a telephone. He said he barely knew the upstairs tenant.

    Police seized Van Iveren’s sword, which he said was a family heirloom.

    On a lighter side, I'm glad no one was hurt and lessons were learned. You never know when someone will kick down your door and have some type of reason. A armed home-owner isn't going to ask first, shoot later.

    This story could have ended up tragic with a would be good samaritan getting shot.

    I saw another news report on this story, said the DVD was porn. lol

    Actually a man with a sword kicked down the door. He used his foot.



    The woman picked up the newspaper with large breasts.

    The man vaulted over the wall with a pencil.

    I was LMAO!! If ANYONE breaks down my door and has a sword in his hand, I'm really, really not going to care what you have to say. You will be FUBAR.
    And what would be in YOUR hand? Your rifle or your gun? :P

    And by 'gun' I of course mean 'self-defense handgun.' What else would I have meant?

    "why the hell would the man have his porn up SO loud you could hear it outside?" :?

    Aside from the fact that it was a mistake. I am glad that if someone had been being raped. this man would have done something about it. and I agree with MarinesWife

    Good samaritan my eye. James Van Iveren has had several run ins with the law, and has done things in the past that raised questions about his mental stability. At best he's a goof who needs to be convicted of the 3 crimes he's committed. It's very possible that he's delusional and needs to be held for observations.

    Even before you posted this, I had my suspicions about this guy.

    Especially when I think of what kind of personhas no phone, grabs, of all thingsan heirloom cavalry sword, and proceeds to start kicking down his neighbor's door. Then goes on to say "I didn't threaten him with the sword, I just pointed it at him."

    Fruit loop if ever I heard of one.

    "The case was dismissed Dec. 21 on the recommendations of prosecutors because a competency examination showed that Van Iveren was not mentally fit to stand trial and not likely to regain competency in the foreseeable future, according to prosecutors' records. "

    Maybe i watch too much Law & Order, but isn't it usually the DEFENSE that makes that recomendation? And if he's not mentally fit to stand trial, how is he mentally fit to be left alone in an appartment with an 83 yr old woman and a sword???

    "The tenant, Bret Stieghorst, satisfied Van Iveren that he was alone in the apartment and would later tell police that nine hours elapsed between the time he was watching a pornographic movie and when Van Iveren burst into the apartment."

    Whether this is true or not, it honestly wouldn't suprise me...this guy doesn't deserve any credit for being a would-be hero.
