Meanwhile, Prince William Clerk of Courts' web site continues to purport to require particular IDs to apply for a VA CHP - sorry Charlie, err, Dave, there is no ID or proof of citizenship required to apply for a CHP in Virginia.

Whats up with the authorities in Prince William/Manassas area? Is there somthing kooky in the water out there?

SUBJECT: Unlawful information & documentation demands from CHP applicants

Dear Clerk Maybie:

At your web link you demand documentation of identity and other status.

Please correct your web site.

Except as provided for in the case of a person requiring notarization, no Clerk of Courts may require documentation of identity, residence, or other information beyond completion of the VSP approved concealed handgun permit application. Items # 2 and 4 need to be deleted.

In the case of a CHP applicant requiring notarization, the duty of care notary statute applies - a Russian passport can be used to notarize the CHP application. So can a Lybian driver's license with no photo.

Only the VA State Police get to determine what information & documentation are required to get a CHP: "There shall be no requirement regarding the length of time an applicant has been a resident or domiciliary of the county or city. The application shall be made under oath before a notary or other person qualified to take oaths and shall be made only on a form prescribed by the Department of State Police, in consultation with the Supreme Court, requiring only that information necessary to determine eligibility for the permit." Va. Code Section 18.2-308(D).

The discrimination against DOD ID Card holders implied in your web site is particularly offensive.

Why on earth would you want to refuse CHP applications made by military spouses or other DOD ID Card holders who do not have VA DLs, and are not required to have VA DLs to drive in VA, and regardless, are free by 18.2-308 to carry concealed handguns using their DOD ID or US Passport and not any Commonwealth ID???

Please let me know what you are going to do.
