Actually this one is pretty easy to explain, but it is still bogus.
In order to search the backup tapes for the long time period requested, they would have to load the base tape, do a search, load an incremental tape, do a search, load the next incremental.... and so on. At some point they would get to the next full backup in the series and repeat the process.
They have to cover the entire time frame this way to capture every email for everyone involved. But the fact is that if there are emails that were sent read and deleted between backup increments these would not be there, and there are better ways to proceed.
Almost every county attorney I have ever dealt with has claimed exemptions that were subsequently denied by independent review. But it does delay the process, and it cost the requester value time and money.
