Virginia Attorney General Bob McDonnell (R) has issued what is essentially a cease and desist letter to New York City Mayor Michael Bloomberg (R) warning that effective 1 July 2007 it will be a felony for Bloomberg or his agents to enter Virginia and attempt to conduct further simulated firearms transactions in support of extra-legal investigations or lawsuit shopping scams.[/b]

Ø McDonnell’s letter is available at http://www.vcdl.org/pdf/AG_McDonnell_letter_to_Bloomberg.pdf.

Ø McDonnell specifically notes that this recent Virginia legislation, signed by Virginia Governor Tim Kaine (D), was initiated by McDonnell in support of the individual rights to keep and bear arms under the Second Amendment.[suP][suP][1][/suP][/suP]

Ø Bloomberg'sextra-territorial gun dealer "stings" are already under investigation by BATFE “in order to determine if violations of Federal firearms laws have occurred.”[suP][suP][2][/suP][/suP]

In related news:[/b]

Ø BATFE Director Sullivan has blasted Bloomberg for grossly misrepresenting the effect of federal gun privacy law under the so-called Tihart Amendment.[suP][suP][3][/suP][/b][/suP] As reported widely in past weeks, BATFE had no trouble tracing the Virginia Tech murderer's firearms within hours after initiation of a lawful investigation (i.e., not civil lawsuit shopping).

Ø The Virginia Citizens Defense League’s “Bloomberg-Gun-Giveway” celebration will be held at the League’s regular membership meeting at 8PM on Thursday, May 17th at the Mason Government Center in Fairfax County, VA, located at 6507 Columbia Pike, Anandale, VA 22003; for directions, call 703-256-8035.A handgun, a long gun, lots of ammunition, and other prizes will be awarded right there in the Fairfax County owned community meeting center with food & drink to celebrate VCDL.org’s successful efforts to promote gun sales at two VA gun dealers fighting Bloomberg’s lawsuit attacks upon the Second Amendment freedom of contract in firearms. All VCDL meetings are open to the press and public. Lawful gun carry is optional at the Bloomberg-Gun-Giveaway celebration.

[suP][suP][1][/suP][/suP][suP] [/suP]A right which in practical, if not legal, terms, was affirmed today by the United States Court of Appeals for the District of Columbia in denying the District of Columbia’s petition for en banc rehearing of Parker v. DC[/i][/b] (striking down DC’s statutory ban on possession of loaded handguns and long guns at home as violative of the Second Amendment’s guarantee of the individual right to keep and bear arms, a right which the court said pre-dated the US Constitution). [suP][suP][3][/suP][/suP] Said Sullivan: "Let me be clear: neither the congressional language nor ATF rules prohibit the sharing of trace data with law enforcement conducting criminal investigations, or place any restrictions on the sharing of trace data with other jurisdictions once it is in the hands of state or local law enforcement. In fact, multi-jurisdictional trace data is also utilized by ATF and shared with fellow law-enforcement agencies to identify firearm-trafficking trends and leads. Additionally, nothing prohibits ATF from releasing our own reports that analyze trace-data trends that could be used by law enforcement." See http://www.saf.org/viewpr-new.asp?id=224.
