North Carolina Resturaunts

I know the law says you cannot CC in restaurants that serve and consume alcohol, But what about OC? There is not much laws regarding OC in N.C. from what I understand. Does that mean OC is up to carriers discretion?

I was emailed a document from the public information officer of the North Carolina State PD. The document does not specifically address openly carrying in a restaraunt. It does say concealed firearms are prohibited in restaraunts. So, my assumption is that OC in NC restaraunts serving alcohol is permitted.

The PDF does further clarify that, by common law, "Going armed to the terror of the people" with a dangerous and unusual weapon is unlawful and that any firearm fits within this provision. This link appears to be a/the case where this was established.

I don't live in NC, but have been brushing up on gun laws in NC because I visit 2 - 3 times a year (and am there now, as a matter of fact).

IANAL, so don't take this as gospel or counsel. I encourage you to research your particular scenario and make your own judgement.

Thank you for the cites. I was playing it safe by not carrying my firearm in those establishments at all because the document emailed to me by the NC State PD was unclear on that. I am glad I now know.

I am, however, kind of perturbed that the document the public information officer sent me did not cite NC code on this.

That FAQ firearms document dosen't read the whole thing on "going to the terror of the people. There is more to it than that and you have to be violating a whole checklist of things to be charged with it.
