I am new to this forum until early this morning i had no idea that it was legal to open carry unloaded let alone open carry loaded in unincorporated areas. The question i have is can you be charged with possesion of a deadly weapon12020 (a) (1). I kind of find it hard to think that i could open carry legally but i can get charged with the above mentioned misdemeanerfor having a police baton underneath the back seat of my truck. which did happen to me, so if anyone can give there input i would greatly appreciate it. The leos in my city have had it in for me from the begining, i would love for them to stop me oc ing unloaded and not be able to do anything about it.

there is another one where you can't bring it into a government building, ie post office, courthouse ect..

12020 lists each item considered a "deadly weapon." Your typical handgun/long gun is NOT listed in this section:

Code:
12020 (a) Any person in this state who does any of the following
is punishable by imprisonment in a county jail not exceeding one year
or in the state prison:
(1) Manufactures or causes to be manufactured, imports into the
state, keeps for sale, or offers or exposes for sale, or who gives,
lends, or possesses any cane gun or wallet gun, any undetectable
firearm, any firearm which is not immediately recognizable as a
firearm, any camouflaging firearm container, any ammunition which
contains or consists of any flechette dart, any bullet containing or
carrying an explosive agent, any ballistic knife, any multiburst
trigger activator, any nunchaku, any short-barreled shotgun, any
short-barreled rifle, any metal knuckles, any belt buckle knife, any
leaded cane, any zip gun, any shuriken, any unconventional pistol,
any lipstick case knife, any cane sword, any shobi-zue, any air gauge
knife, any writing pen knife, any metal military practice
handgrenade or metal replica handgrenade, or any instrument or weapon
of the kind commonly known as a blackjack, slungshot, billy,
sandclub, sap, or sandbag.

Each of these items is more specifically defined further down in the section.
