Can we OC/CC in Bars/Restaurants or Alcohol stores?

I've read that you're not allowed to CC or OC into any establishment that serves alcohol (like a regular restaurant). Does this Apply to us in Indiana?

Also is it legal for me to CC or OC into a alcohol store as long as the owners are alright with it?

I did more investigating and All I see that it is illegal for liscensed carriers is on Public property such as Public school, Court house, police/fire depts etc. and the post office.

No mention of establishments that sell or serve alcohol.

I'm going to Hooters tomorrow in merillville. I'd like to OC instead of CC for once, so I'd like to know for sure.

This might help you. Indiana code lists the following locations as off limits:

In or On School Property.
On a school bus
In or on property that is being used by a school for a school function
Private School(IC 20­9.1­1­3) & (IC 35­41­1­24.7)
Head Start (IC 35­41­1­24.7)
Preschool (IC 35-41-1-24.7)
IC 35­47­9­1Allows the carry of firearms by persons permitted to possess and who are transporting a person toor from school or a school function.
On an aircraft
Controlled access areas of an airport
During annual Staee Fair 80 IAC 4-4-4 (Must lock in vehicle)
Shipping port 130 IAC 4-1-8 (Controlled by Indiana Port Commission)
A riverboat Casino



68 IAC 1­7­1 Weapons on the Riverboat (d) The riverboat licensee shall provide a secure place to which patrons do not have access to store weapons checked by patrons, off duty law enforcement officers, or off duty federal enforcement officers.

This Is A Very Good Question: and the answer is yes, i have been doing some investigative researchon some of the laws here in the state of IN. and have found out that if it is not in the INDIANA GUN CODE than it is not illegal for you to do so, you can carry into any restaurant, bar,or any establishment that sells alcohol, with your weapon and"LTCH"License To Carry Handgun on you,however if you enter any one of these establishments and consume any alcohol and a police officer stops you to check you out and finds that you have you will be on your way to jail and be find with a felony. There is nothing in the Indiana gun code that says you can not enter with your weapon but as always you should use caution when doing so , you are opening yourself up to a lot of on lookers who will call it in and it will sound like this " hello 911 whats your emergence,(caller) hey i'm at #%$%$BAR and there's a man in here with a gun,(911) okwhat is he doing?,(caller) nothinghe"s just in here eating and he's got a gun on him, (911) ok can you tell me what he looks like ,(caller) he"s got on a black ballcap a black jacket and blue jeans, (911) is he black or white (caller) he"s white (911) ok someone is on their way do not say anything to him (caller) ok hurry......., this is a caller who doesn't know anything about the laws in Indiana , but had they,then they would have known that it is not illegal for him to be there, and that he has every right to be there with his weapon, you should always check your local laws before doing or going anywhereif you are not sure of the laws.

I don't see how having a glass of wine with your dinner has anything to do with carrying a gun. As long as you are not using it or causing a disturbance (man with a gun calls are not a disturbance) I would imagine you would be all clear. I equate this with having a few too many and deciding to "sleep it off" in the back seat. You are in the car, but you are not opperating it, so they can't give you an OWI or DUI. Can you referance the section in the Indiana Code that shows you have to be 100% sober to carry a firearm? Thanks.

There is nothing in Indiana code regarding drinking while carring. That said, if you have to draw, your blood alcohol level will definitely be a factor when the DA decides whether to charge you or not.

I agree with you 100%. I'm just saying it's not illegal to cosume alcohol while carrying. Just do so at your own risk. I don't drink anyway, so it don't affect me.:D
