[/font][font="verdana,arial,helvetica,sans-serif"]Manassas police are searching for the suspect in the shooting death of a man Saturday morning. [/font][font="verdana,arial,helvetica,sans-serif"]Robert A. Briscoe Jr., 18, of no fixed address, is wanted for one court of murder, one count of attempted murder, two counts of robbery and two counts of using a firearm in the commission of a felony, according to a news release issued late Saturday night.

[/font] [font="verdana,arial,helvetica,sans-serif"]Police say Briscoe should be considered armed and dangerous. He was last seen near Va. 234 and U.S. 1 in Dumfries, said Sgt. Tim Neumann, police spokesman.[/font]
[font="verdana,arial,helvetica,sans-serif"]Around 1 a.m., Officer D.W. Hylton found an unconscious man lying on the sidewalk in the 8700 block of Weems Road, Neumann said. Rescue workers tried but were unable to resuscitate the man while en route to the hospital.

[/font] [font="verdana,arial,helvetica,sans-serif"]Police are withholding the victim's information until family members are notified.[/font]
[font="verdana,arial,helvetica,sans-serif"]The preliminary investigation indicates that the victim was shot during an armed robbery, Neumann said. The victim was walking with another man, who was also shot at but not injured.

[/font] [font="verdana,arial,helvetica,sans-serif"]Police said Briscoe is a white man, 5 feet 11 inches tall, 165 pounds, with blue eyes and blond, buzz cut hair.

[/font] [font="verdana,arial,helvetica,sans-serif"]Anyone with information about the shooting is asked to call Manassas City Crime Solvers at 703-330-0330. Callers don't have to give their name, just the information, and could earn up to a $1,000 reward for information that leads to an arrest in this case.[/font]

This is very interesting, especially in light of LEO 229'srepeated insistancefor ID productionby those he makes investigatory contacts with. If Briscoehad been a member of this forum, he could have heard thestrong opinions about not legally having to assent to the dreaded "show me your papers, please" request. I'm pretty sure he would have liked that advice.

IIRC, LEO 229 tooksome grief overhis position on ID...

Manassas police arrested Richard A. Briscoe Jr., the suspect in the murder of a 23-year-old Mexican immigrant, after a nearly four-day search.

Briscoe, 18, of no fixed address, was found in the 13600 block of Lynn Street in Woodbridge around 7:45 p.m. Tuesday, said Sgt. Tim Neumann, police spokesman.

He is charged with first degree murder, attempted first degree murder, two counts of robbery and two counts of use of a firearm in the commission of a felony and is being held without bond pending a Nov. 13 court date.

According to police, Victor Moreno Orozco was walking with a friend on Weems Road in Manassas around 1 a.m. Saturday when a man approached them, started a conversation and then demanded money.

The men refused to hand over money, police said, and the robber pulled out a gun and shot at both of the men, hitting Orozco several times.

Orozco, who was on his way home, was taken to the hospital where he was pronounced dead.

Police had stopped Briscoe down the street from the incident on the night of the shooting, according to a criminal complaint. But thecomplaint goes on to describe Briscoe as being "evasive" at the time and also states that he would not agree to a consent search.

But after finding an empty .25-caliber Winchester ammunition box -- the same ammunition found at the scene of the homicide -- outside of the house on Calvary Lane in Manassas where Briscoe was living, police had the evidence needed to get a search warrant, according to the complaint.

During a search of the house, police found the shooting victim's wallet, paycheck and ID card.

Prince William County police and the U.S. Marshals Capital Area Regional Fugitive Task Force assisted in the search for Briscoe.

but in thisinstance when they stopped him on the night of the crime, werent they just looking for evidence to link him to the crime and not necessarily out to ID him as the person who commited the crime?

I'm referring only to the positive identification of Briscoe that was made on the night he was stopped near the murder scene. That positive identification, no matter how it was done (probably by an ID) obviously allowed follow-up investigation.

However, if Briscoe had just insisted that ID was not necessary to be produced and the LEOs accepted his inistance....well, that would have been a different kettle of fish...

I think this is an exemplar for LEO 229's point on IDs. It very strongly supports his position...
