I think he is based on the following which is an e-mail communication I had with him over the last 2 days asking for him to request an AG opinion on Open Carry and whether or not a Terry stop applies. Keep in mind that it is in reverse order.

Rep. McCoy,

I am not allowed by law to ask for an AG opinion. Besides that I have
asked and they directed me to speak to an attorney. Only Judges, State
Congress and Legislature, and heads of Police Dept's are the only ones
allowed to request an opinion.

Are you not willing to ask for an opinion from the AG? If so why not.

Hello,

About 2 or 3 months ago I wrote to request that Rep. McCoy ask for an
Attorney General opinion on the legalities of openly carrying a firearm. As
I stated before there is a increase in the number of people that are openly
carrying firearms as well as many training bulletins issued by Police Dept
heads to thier officers regarding open carry. I was told that Rep. McCoy was
considering requesting an opinion reagarding this and I recieved a phone
call from an investigator at the Snohomics County Prosecutors office that
told me that while open carry probably was legal it was silly. This is not
exactly the response I was hoping for or wanting. There have been many
actions around the state by law enforcement officers that amount to possible
constitutional violations as well as unlawful siezure. These actions of the
officers, while I do agree with them on a safety standpoint but not on a
constitutional standpoint, are possibly creating an atmosphere that will
result in a law suit with themselves, thier deptartment, and the
municipality as defendants. To me this would be a tragedy to all taxpayers
as this could result in a great deal of monetary loss resulting in cutbacks
that could take years to recoup.

I am asking once again that Rep. McCoy request an opinion from the
Attorney General about the subject of open carrying a firearm and whether or
not it is grounds for a Terry stop. He can learn more about it at
Opencarry.org and nwcdl.org. I would also urge him to read the Washington
State Supreme court rulings of State v. Casad, while it was not published it
does give an indication on how the courts view openly carried firearms, and
State v Day, I am unsure if it was published.

Unless you are a Native American or wish to do business with the Tulalip Tribes (Casino, Quilceda Villiage, Outlet Mall, or other Reservation Location) Rep. McCoy doesn't have time. He is too busy trying to get the Sales Tax Revenue that the above businesses collect remitted back to the tribe.

He is not one of "our representatives" he is more "their (meaning Tulalip's) representative. Don't expect any help as he isn't one of the brightest bulbs in the chandelier.

I would try the Police Chief but I am not a big fan of Scharf, he is, like most of them, to politically involved, and IMHO not a LEO. I was thinking Lovick but I seem to remember him asking someone why they felt they needed to carry a gun. I'm pretty sure Rick Bart won't do it since his term is almost up.

Amlevin do you know anything about Rep. Mike Sells?

My guess is no, since county officials aren't voted on by anyone outside of the county. What's interesting is this list excludes police chiefs and county sheriffs.

No, statewide means everyone in the state votes for them. Examples of this would the Gov. Lt. Gov. Sec. of State, etc.

Someone should send the above list to the moron on McCoy's staff that evidently doesn't know the process.

The funny thing is that the moron on McCoy's staff is actually McCoy, at least I think it was him. He is the one that responded to my e-mails. Every other time I have had contact with him or another rep thier staff has returned the response from thier own e-mail address, not to mention very good grammar and well spoken. This one came directly from McCoy's e-mail and not a staffer. It's OK I replied to him with basically a I can tell you are an anti-gun rep who wants to trample on the 2A and I will make sure everyone I know who owns a firearm knows it.

I looked through Mike Sells record and cannot find anything that would indicate to me which way he leans on the 2A and citizens right to carry. I think I am going to fire a request off to him.
