Newport News Judge's stupidity overturned by higher court
RICHMOND (October 25, 2007) - - The Virginia Court of Appeals struck down the unconstitutional actions of Newport News Circuit Court Judge David F. Pugh who refused to issue concealed carry permits to certain military personnel.

Pugh had denied permits to military service members unless they provided him proof they planned to remain in Virginia after their service ended.

The Virginia Citizens Defense League (VCDL), alleging Pugh was acting illegally, took a test case to the Appeals Court after unsuccessfully trying to negotiate a solution with Pugh and the Newport News City Council.

Military police officer Christopher Deteresa, a test case, was denied a permit by Pugh. The VCDL footed the bill to hire lawyer Richard Gardiner to take the case on appeal.

A spokesman for the VCDL said, "The Court of Appeals, after giving the Judge some basic English lessons (I can just picture the Court of Appeals rolling its collective eyes), ordered Judge Pugh to cease denying permits to the military stationed in his jurisdiction solely because they are not
permanent residents!"

Pugh could have avoided the embarrassment and public exposure of his stupidity by listening to reason, but refused.

"Stupidity" this profound in an otherwise intelligent and well-educated man usually indicates an underlying political agenda. Now that he's been caught and publicly humiliated for trampling someone's rights, he will probably be a lot more careful in the future. If not, we can always tar-and-feather him again.

yes - election and reelection is done by the VA General Assembly - key committee is the House Courts of Justice committee - that committee definitely needs to review Judge Pugh's record in this matter before he gets reelected to any judicial position.

We don't know what the judges motivation was.Is he an anti gun nut or is he an illiterate boob?? We don't know, but either explanation is quite scary. We either have a judge that does not follow the law or we have a judge whose grammar skills are so deficient that his ability to properly apply the law is impaired.

I would like to postulate that he is probably an activist who applies the law as he thinks it should be, substituting his own judgment for that of our elected officials. Not good for those of us who take our liberty seriously.

Isthe activism of this judge against guns, or is it against those military types having guns? That sort of - we don't want the military people to have guns in our town - attitude does exist in North Carolina, just read some of the N.C. threads.I really hope that this is not what it is.

It just pisses me off that the judge would unjustly deny our armed forces, those who have sworn an oath of allegiance to our constitution, something as basic as a concealed carry permit.

Then again, the judge may just be an illiterate boob.

Open carry is already legal.
