Private Firearms Transactions Under Attack!

[size=][/size] Today, January 18 the Virginia House of Delegates Militia, Police and Public Safety Committee will hear two proposals that could serve as a first step toward regulating all private firearm transactions. Both bills, House Bill 592 offered by Delegate Dave Marsden (D-41) and House Bill 745 offered by Delegate Chuck Caputo (D-67), would require state and federal background checks to be conducted on all firearms transactions at Virginia gun shows.

Federal and state law already requires federally licensed firearms dealers to conduct a background check on all prospective purchases. This legislation is simply a first step toward requiring government approval before individuals may sell their private property, even between family and friends.

Please act now by contacting all Committee members and urge them to defend your Second Amendment and privacy rights by opposing both HB592 and HB745!

Opposing the Heavy Hand of Gun Control on Private Citizens

Alexandria -- Expressing his grave concern with Governor Kaine’s
proposal to force private citizens to perform background checks when
selling at gun shows, Governor Jim Gilmore sent a letter today to
Speaker Bill Howell, at the Virginia House of Delegates.

Text of letter follows:

I wish to express my serious concerns with Governor Kaine’s proposal
to force private individuals to perform background checks when selling
at gun shows. This proposal would abridge the rights of private
collectors while distorting the intent of the law.

There is no “loophole” that applies to gun shows. Federal and state
law applies to gun shows in exactly the same manner as anywhere else.
The vast majority of sellers at gun shows are federally licensed
dealers who are required under current law to perform instant
background checks on their customers. The remainders are private
sellers who are not required in any setting – gun show or otherwise –
to submit to the same regulations that apply to licensed dealers.

There is absolutely no evidence to suggest that bringing the heavy
hand of gun control down on private sellers (who are usually
collectors who buy, sell or trade a very small quantity of guns) will
do anything to reduce violent crime. A 2001 study by the Bureau of
Justice Statistics (BJS) found that less than one percent of guns used
in crimes have come from gun shows. Numerous other studies by the
Department of Justice and academia have revealed similar findings.

It is clear that subjecting private collectors to more gun control
regulations would do nothing to reduce violent crime, while setting a
dangerous precedent that all private firearms transactions would be
subject to regulations that were intended to apply only to licensed
dealers, not private individuals. Our attention would be better
focused on enforcing current laws, and ensuring that law abiding
citizens are not treated as criminals.

I would like to remind you that there is no gun show loophole!!!

What we are really talking about it is getting to a point where private sale
background check and defacto gun registration exists on every single
firearm transaction in the commonwealth.

Licensed dealers must do background checks and private individuals do not.

The vast majority of sellers at gun shows are federally licensed
dealers who are required under current law to perform instant
background checks on their customers. The remainders are private

Our attention would be better focused on enforcing current laws, and
ensuring that law abiding citizens are not treated as criminals.

Studies show criminals DO NOT get their guns from gun shows. They steal
them and buy them from other criminals who stole them.

Please don't expect Virginia's criminals to obey your new laws anymore
than they obeyed your old laws.

"closing the gun show" loophole is feel good legislation that solves no
issue and further tramples on the rights of Virginians to keep and bear arms.

P.S. I would also request that you amend the concealed carry regs to allow
restaurant carry with no consumption of alcohol. It is silly and dangerous
to force law abiding permit holders to to make sure the gun is unconcealed
while eating lunch at a place that serves alcohol.

RICHMOND, Va. (AP) -- Emotional pleas by relatives and friends of Virginia Tech shooting victims failed to persuade a House of Delegates committee to close a loophole that allows criminals and the mentally ill to buy firearms at Virginia gun shows.

The Militia, Police and Public Safety Committee voted 13-to-9 today to kill legislation that would require unlicensed sellers at gun shows to conduct criminal background checks on buyers.

Such checks now are required only on transactions by federally licensed gun dealers.

House committee kills gun-show loophole bill

The General Assembly's House committee on Militia, Police and Public Safety today killed the House's version of the gun-show loophole bill.

By a vote of 12-9, the committee killed the proposal, which would make all sales at gun shows subject to instant background checks.

Before voting, the committee heard testimony from members of the Virginia Tech community and from gun rights advocates. Committee members briefly discussed the proposed legislation before voting.

Parents of students killed or wounded in the April 16 Tech shootings urged the committee to approve the bill.

A similar bill is still in play in the Senate Courts of Justice committee, which is scheduled to again Monday morning.

Andrew Goddard, a Richmond resident whose son was wounded at Tech, said today, "We'll be here en masse for that one."

LuAnn McNabb, friend of the family of slain Tech student Reema Samaha, said she was disappointed but not surprised by today's vote.

Philip Van Cleave, president of the Virginia Citizens Defense League, said he was happy with today's vote.

"It had nothing to do with Virginia Tech, he said. "It had everything to do with freedom."
