I am moving to Branson Mo. from Texas.. I was wanting to know if anyone has any info on OPEN CARRY is Branson and or surrounding areas....

Yes, but does it allow a concealed carry permit holder to open carry? That is why I said call the city attorney for clarification.

Guess I misunderstood. thought he wanted to know about open carry only. Yes, the way I read it if you have a permit for concealed carry than you can opencarry with out penalty. However I would think that if they take this stance against open carry as a whole you are more likely to be stopped and hasseled. As long as you don't mind "Ejumacatin" the LEO's then open carry away!! (man I hope we get full pre-emption soon!!)


I would print off this part of the law and keep it with you "Just in case"

I agree with your advice to print the particular ordinance and carry it with you.

I am going to Branson for a motorcycle rally in May and am interested in this myself.
Sometimes it pays to pick and choose your battles. With Branson being a tourist area, the chance someone is going to call the local law enforcement on an individual OCing would be high.

Then again, I don't really care if they call or not. If it is legal, f' em!

(personally, I have only been questioned once concerning OC)

I would strongly consider contacting their police chief and/or city attorney before OC just in case the interpretation isn't in favor of OC b/c the wording of the regulation is very questionable.

You are mistaken. Missouri has partial firearms preemption which allows local municipalities to regulate two things:

1. The open carry of weapons

2. Discharge of firearms.

Example; I live in Cape Girardeau MO where open carry will get you a citation, yet eight miles away in Jackson, MO open carry is legal.

As a matter of fact, if you open carry in the City of St Louis, you WILL be arrested.

After two hours of searching their codes I find this is the only item that refers to (open Carry)(Plain View). The parts that havesaid open to the public seems to be just that. City places opento the public. To me it is saying a concealed permit allows open carry but of course normal restrictions. I believe there has been an instructor that said there was a city ban on open carry. Perhaps there is but I'd like to see it and it would be a good idea to check with the city atty etc. for your own protection.

Peter Herschend has spent considerable money opposing the passage of concealed carry in the state and is probably a prime reason that CCW is forbidden inside "the gated area of any amusement park."

In Branson his company owns the two theme parks Silver Dollar City , and Celebration City ; White Water Branson a themed water park; and a riverboat attraction on Table Rock Lake called the Showboat Branson Belle . Besides operating Marvel Cave, HFE owns nearby Talking Rocks Cavern . The Wilderness at Silver Dollar City is the parks official campground. His company also owns the Ride the Ducks concession in Branson. This along with a half interest in the Dixie Stampede there.

Given how large a force the Herschends are in Branson and the surrounding area and Peter Herschend's antigun history and influence, you can probably count on the law being interpreted as negatively as possible with regard to CCW permittees carrying openly. At the very least, you'd probably find yourself with a charge of public disturbance.

You're right. I've known that family for more than 30 years and they have opposed CCW and gambling for years, butCCW still happened and things have made strange turns in Branson.

I CC in Branson every day and at times open carry for a quick trip to the store etc. My business takes me to Silver Dollar City weekly and you can bet that I don't carry there. You can't imagine how many retired Leo's, miltary and such there are at any given time let alone CCW's. I would think a lot of them are still armed. Hopefully we will see open carry in Branson more often.

Heschend managed to kill the proposed casino in Rockaway Beach. In doing an online search on his name, I was amazed at the hundreds of thousands of dollars he's donated to various Republican party candidates and causes over the past decades. That adds up to a lot of influence.

Given his influence, I'd predict that the instant some CCW holder was accosted for open carry and proved to be legal, Branson's municipal code would be amended to "correct" that little oversight.

We seriously need to pass complete pre-emption next year if we can just get a new Senate President to replace Michael Gibbons.

Ya know, the way that law is written it sound like you could carry "California Style" Open Carry, unloaded with a full magazine ready to be inserted. If the magazine full of ammo isn't in the weapon, then it isn't "equipped or rigged in a manner which would allow such firearm or projectile weapon the capability of the discharge of such ammunition and/or projectiles"

Missouri weapons law lawyer Kevin Jamison <http://www.kljamisonlaw.com> mentions on his website that if you wish to test various questionable or ambiguous provisions in the law then it is a good idea to obtain a 55gal. drum, fill it with $100 bills well packed, and be prepared to spend it and more to be the test case.

This is a concept worth keeping in mind when contemplating going up against the ordinances and enforcement habits of small towns dominated by influential antigun individuals, families, clans, or political machines.
