I would OC until you get your new one. You are not legal unless you havea valid permit on your person.

Nope you are not legal with a expired permit.

You need to have a valid permit to legally carry concealed.

You can open carry without a permit and be legal, you just can't conceal until you get the new license.

I should rephrase the question I can't carry loaded in a vehicle unless i have valid cpl so how do i go about carrying in the open there is really no point in carrying a unloaded handgun in a vehicle if thats how i travel. No sense in haveing to unload reload and store my firearm everytime i get in and out of my vehicle.

What I did before I got my CPL was carry in condition 3 - Israeli carry - and just pop the magazine out when entering a vehicle. Quick, easy, and reasonably discreet. Definitely not recommended long-term, but it's better than nothing until your new CPL arrives.

(Well, maybe not quite condition 3. Sight M1911 describes condition 3 as the hammer down on an empty chamber with a full mag. I carried with the hammer back, to make chambering a round easier.)

I guess the best thing to do is wait until my permit arrives I would rather be legal to carry in vehicle with it loaded than having to unload reload everytime i get in and out. Thanks for the input guys.

Plus when I OC I want to be legal in every aspect as not to give the LEO's reason to bust me for carrying illegal. Most people travel by vehicle. So in a sense you do need a CPL as most people travel by vehicle. Nice trick wa state.

RCW 9.41.50
(2)(a) A person shall not carry or place a loaded pistol in any vehicle unless the person has a license to carry a concealed pistol and: (i) The pistol is on the licensee's person, (ii) the licensee is within the vehicle at all times that the pistol is there, or (iii) the licensee is away from the vehicle and the pistol is locked within the vehicle and concealed from view from outside the vehicle.

(3)(a) A person at least eighteen years of age who is in possession of an unloaded pistol shall not leave the unloaded pistol in a vehicle unless the unloaded pistol is locked within the vehicle and concealed from view from outside the vehicle.

However if that pistol is unloaded can he still open carry that pistol in the vehicle? 3A if broken down could have 2 meanings but IMA if you are in possession of the weapon then it has to be cased & locked. It doesn't say carry, it doesn't say stored, it says leave. If you leave it on the seat or on the dash or in a holster it still has to be cased & locked.
I could see where 3A is in a gray area about "leaving" the pistol in the vehicle. I could take this to mean storing to run an errand, etc.

Could be a argument there but I'm not a lawyer (IANAL).

As long as you are in the vehicle the firearm does not have to be cased and stored. As you said the code says shall not leave. If one were not allowed to have an uncased and unloaded pistol in the car then the code would have to say shall not have. At least that is the way I see it.

Nothing in there says anything about cased or locked inside a container. It merely says the vehicle must be locked and the pistol out of view if it is left alone-loaded or unloaded. It doesn't say it must be cased and locked if you don't have a CPL, it just says it can't be loaded.

I am interested in how long it takes you to get your renewal.

Under sheriff Bart CPL's typically took 7 to 10 days in Snohomish County. I sure hope the change in sheriff's hasn't changed that (although I suspect it might).

I am betting I should recieve it after about 14 days or so if not I will be callin them to find out what the hold up is.I have a washington state gaming licence for casinos so it should not take this long.and former military for 10 yrs.The day I went in it took like 2 hrs before I could even go in the back to process my app. They have been short staffed they said. But under law they can take up to 30 days so they are well within the law.

In 2007 I had a late renewal (again) in Snohomish county. I got it in under a week.
I wish they would send reminders like they do with car tags

Man, I wish being military sped up the process. My town is fairly small, and that's a good thing.. about 14 days for mine.Every time they see me im in my uniform. But they didnt seem to care..

good thing is.. As, we don't enforce the law. we are however expected to follow it in greater detail, so it usually helps us out (military, retired) With a fast background check!
