It looks like you caught something I missed. The NICS check does prove that someone qualifies to posess the gun and of course someone has to posess it before they can carry it. However, private sales and non-federally licensed dealers I don't believe have to do the NICS check anyway. Regardless, I don't believe that this law regarding the GFSZA has ever been enforced in Arizona unless it was added to someone's charges for committing some other crime. I certainly think it is good to try to get it repealed or overturned but I don't think you need to worry about being busted for it in the mean time. Have you lived in Arizona for awhile? If you are from here, you should know that the cops don't care about this law and that OC is a tradition here. Even if you mistakenly carried ON school property there is even a good chance that a cop would just escort you out and warn you rather than arrest you. I do believe you are worrying excessively about this law. Remember this is Arizona, not Maryland or a state of similar gun laws. I've carried near schools hundreds of times and nobody including the cops ever bat an eye.

I was born and raised in Tucson, so AZ customs aren't exactly foreign to me.

Like I said before, I've OC'd my loaded XD at Second Amendment Sports across from Ft. Lowell Elementary dozens of times without problems. I've even carried in public parks (a big no-no without a CCW, I've learned.) But I do not know how long AZ's gun friendly climate will last with so many Illinoisans and New Yorkers moving here to retire. All it takes is a 911 call from one hoplophobe to ruin your entire day.

AZ has been OC since the beginning of measured time. If you're a citizen... and not otherwise prohibited by somethin' you've done to deny you the Right... You can strap on that piece openly 'n go wanderin'. It will be novelty at first 'n you'll be self concious. After awhile... you'll feel nekkid w/o it. 'Like yer hat.

Welcome Bro! I have ben here a very long time & as a retired FLEO, I think your approach of waiting for your AZ permit is a smart one. Some ads mislead. ie... get your NV permit, less time recognized by AZ. IT IS RECOGNIZED BYAZ ONLY IF YOU ARE ANV RESIDENT. You are expected to get permitted in your state or residence. This is true in many, many, many States.

Why no OCing in the parks without the permit? And what do cops do when they get a call about OCers? No less than 50 cops have seen me OCing here, including in parks, and not one has ever so much as looked at me funny.

There is a little history about carrying in parks in AZ. Initially, you would see a sign, like "No Discharging firearms in the park.

Now that didn't rule out carry, just discharge! Now I assume that if I am going to discharge in a park or anywhere elese, I'm going to have a gtood reason.

Then came the law than banned carry in parks!

Those in the know at that time, knew that since these postiongs did not include the ID of the enabling Statue, They weren't worth the paint job!

Now they have begun to "include enableing statues", which does ten to nail you down.

Parks are the sole exception to the state's otherwise excellent preemption law. 13-3108 paragraph 5 limits firearms possession in parks of one square mile or less to those who have CCW. Larger parks can also limit firearms possession in "developed areas" (read: picnic tables, playsets, tennis courts, etc.) to those that have a CCW.

It allows for localities to limit possession provided the park is has proper signage. 13-3108 in and of itself doesn't prohibit carrying in parks without a permit.

EDIT TO ADD: I have not seen a single park in Yuma with any kind of sign limiting carry.

Thanks for the clarification, whiskaz. I didn't realize it was a local thing because all the parks I've been to in Tucson are posted no weapons, except the one where my brother works. I thought that maybe somebody just stole the signage.

To be honest, I'm more worried about the exodus from SoCal.

Activate the National Guard and put them on the banks of the Colorado to turn away any vehicles with Cali plates. ;)

Yeah thats right....hey wait a min...I am from california. I have no problem with the laws, I actually like the possibility to OC if I choose. I carry most of the time when im out.

Oh and while im here: Is there a law here limiting mag. capacity to the general public? I have a few that hold 16 or so, are they legal here?
