As his wife (and one who obviously knows the whole story), I'd just like to say that I am very proud of the way my sometimes hotheaded husband handled the situation. He has every right to be angry about the way he was treated, and I'm behind him 100% in the action that he is taking against them for violating his civil rights, both 2A and 4A. Personally, I would have plead the 5th, which probably would have gotten me taken to jail, but after watching the "Never Talk to the Police" video, that would have been my reaction in a situation like that. It's one thing to talk to a police officer who is not violating your rights, but it is quite another to be handcuffed in the back of a car and to be forced to reveal your personal life when you've done nothing to warrant such an action, in my opinion.

wow. i'm sorry to hear that Jarhead. I Live in Puyallup and have had several interactions with the PD. both good and bad. most of them are hotheaded and have an itchy trigger finger. that is one reason i haven't OC'd in my home town yet. i hope you get some satisfaction in your case. sue the ever lovin' hell out of them. i'd be a helluva lot happier seeing my property taxes going to you than to the damn casino.

From the sound of things, you ran into a couple of thieves with badges. In addition to suing the city, the PD, and the individual officers, you should report your weapon as stolen. The thieves were two uniformed police officers who used their position as police officers to STEAL your pistol. This could be a federal offense and might result in some hard time for them. If we're lucky maybe even federal hard time.

You have my sympathy jarhead. Randy is the man and will do you good. Still waiting for 60 days to go by before throwing Snohomish County a lawsuit they won't soon forget after my Subway incident in Everett. Be strong man. Hope you get your gun back.

One question: Do I need a license to CC a recorder?

All joking aside, carrying a recorder is great advice. It'll be my next electronic investment.

Sounds to me as if he knows OC is legal in WA. If he comes to this site he knows you did nothing wrong… maybe he knew where you were going by this forum, followed you, and at the right time made his move to get your gun that he wanted for so long, free gun. Just joking.
But anyway I will be getting a recorder myself, and don’t give up on this fight man.. I got unlawfully arrested on my motorcycle in 06. But I just did not follow through with the case to win money… NEXT time I will . So you Stay in the fight this is just crazy

If your wife was there she should have called 911 and reported and armed robbery and kidnapping. They said you weren't detained but they still bound you and put you in the back of their car. That's kidnapping.

Jarhead, sorry you had to go through that with those clowns. I'm sure Randy Loun knows the best way to handle the situation, but just in case (and for everyone else) here's a little trinket I found from the FBI:

Take a look, it sounds like they are pretty forward about dealing withAGENCIES who allow officers to abuse their power, but then again they only handled 1,100 cases in 2005. It doesn't look like they take actions against an individual officer, but I'd guess that if a police department had to deal with an investigation by the FBI and then the US Attorney General, they'd make sure it doesn't happen again.

Jarhead, keep on them, we are behind you.

What I find strange is that if this officer does come to this site and sees whats going on here then goes and makes a stupid detention I would think he would fall under the "color of law" federal offense for sure as he is " knowingly " violated federal rights of jarhead. He cant plead ingnorance of the law.

WANTED:
Two positions are opening up in Puyallup if anyone wants to be a LEO. You must be level headed as we now have rules that are required to follow.

so today i contacted the police again and they were relucktant to surender my weapon yet after a nice long talk with the SGT who took it he decided it was in his best intrest to surendner it back to me. So yes i have my gun back all ammo accounted for but it does look like they did a bullistics test on the weapon and didnt clean it before giving it back..........

Hrm, so I was wrong on the ammo not being 100% returned....

But Randy will have a nice field day with the fact they're treating you like a criminal by doing ballistics tests on a firearm illegally seized.
