LOADED open carry in California

What does the law say about LOADED open carry in California? It seems to me that it is pointless to open carry a pistol that is unloaded. it is akin to belting yourself into a car that has no fuel in the tank. I want to push the issue in the courts, to say that the "feel good" compromise of being able to open carry a gun that is not loaded accomplishes nothing beyond giving the criminal advance notice that he must overpower you BEFORE you can load your gun. I really want to press the issue. Opinions?

In California, you can open carry loaded only in places where the discharge of firearms is legal.

I wish you the best of luck in getting the law changed.

It's a little more complicated than that. You can only open carry loaded in unincorporated territory where the discharge of firearms is not prohibited.

You really need to read the California Open Carry Flyer and the California Open Carry Pamphlet.

There is all the information you need to know what is legal and what is not legal in CA.

CA Penal Code

12031. (a) (1) A person is guilty of carrying a loaded firearm when
he or she carries a loaded firearm on his or her person or in a
vehicle while in any public place or on any public street in an
incorporated city or in any public place or on any public street in a
prohibited area of unincorporated territory.
