New Year's Alert: The Texas Legislature trickles into Austin next week and we still do not have a bill introduced officially - everybody needs to contact their state representative and senator - and do it again right now even if you have already done so - just follow the action items below!

-------

Let's let the Texas Legislature know we want action on open carry rights restoration. If you live, work, or go to school in Texas, now would be the time:

Action Item 1: Email your STATE (not U.S.) Representative

Find your State Representative at http://www.fyi.legis.state.tx.us, then go to his/her web page, and send a web form email.

Suggested Message

SUBJECT: Please sponsor legislation to restore open carry rights in Texas!

Dear Representative ________:

I ask you to sponsor legislation to restore the right of Texans to open carry holstered handguns. A draft of such a bill can be found at http://opencarry.mywowbb.com/forum51/17181.html.

The facts are pretty stark - Texas is one of only 6 states banning the open carry of handguns. Of the 44 states which allow the open carry of handguns, only 14 states require any license to open carry. See map at http://www.opencarry.org/opencarry.html.

And despite the widespread open carry rights outside of Texas, a recent FBI study that essentially says that bad guys don't open carry. See Anthony Pinizzotto, et al., Violent Encounters: A Study of Felonious Assaults on Our Nation's Law Enforcement Officers, FBI (2006) (finding that violent criminals carefully "conceal" their guns
and "eschew holsters"), summary available at
http://www.forcesciencenews.com/home/detail.html?serial=62

It's no wonder then that over 46,200 Texans have signed an online petition at http://www.petitiononline.com/texasoc/petition.html to restore the right to open carry in Texas.

As the DC v. Heller decision made clear, the Constitutional right to "bear" arms relates to the carrying of unconcealed guns. Slip Op. at 10 & 54-57, available at http://www.scotusblog.com/wp/wp-content/uploads/2008/06/07-2901.pdf.

Even for those who desire to conceal their handguns most of the time, the absolute ban on un-concealing handguns is not just an onerous mandate, it is essentially impossible to comply with at all times in all conditions. For example, under Texas law it is unlawful for any person to un-conceal their handgun (i.e., take off one's coat) even when visiting a friend's home, farm, ranch, or business.

I look forward to hearing from you on this matter.

Sincerely,

YOUR NAME

Action Item 2: Email your STATE (not U.S.) Senator

Find your State Senator at http://www.fyi.legis.state.tx.us, then go to his/her web page, and send a web form email.

If I may opine for a second, over on the Texas CHL Forum, they have ample experience calling their local rep to deal with the current backlog on CHL applications. The general consensus has been to use snail mail, or call, instead of e-mail if you really want a response. E-mail is easy;Mike's written the letter, all you have to do is copy and paste it into your e-mail program and send it from however many mail accounts you have. As such, it is not given as much weight as a stamped letter. An inbox can be cleaned out in a few minutes and it doesn't have the same weight (on many levels) as one of those white bushel-size mailbaskets full of letters arriving every day.

I certainly encourage those here to copy and paste the letters, not into Outlook or Thunderbird, but into Word or OpenOffice. Print them out, with a copy of the bill, put them in an envelope, stamp them and drop them in the box. It'll cost you just over $1.00, you'll give the postman something to do besides deliver junk mail, and you'll be taking a far larger stride to get your senator's attention.

Interesting observation and yet another talking point to support open carry!

Under our bill, all the folks waiting for their CHP permission permit could at least open carry while they waited!

Folks - how is this going for each of you? So far our feedback has been favorable with no legislator on record as opposing restoring OC rights!

Just got this response from Representative Eddie Rodriguez's office:

---snip---
Mr. Leal,

Thank you for your e-mail regarding Open Carry legislation in Texas.
While Rep. Rodriguez would agree that Open Carry makes more sense than
the current concealed handgun laws that Texas has adopted, this is not a
bill that he is interested in filing. For the most part, Rep. Rodriguez
is an advocate for gun control.

We do appreciate your e-mail and all of the good information on
opencarry.org.

Sincerely,

Nate Walker

Rep. Eddie Rodriguez

463-0674
---snip---

So, we have our first total "NO" to this legislation.

in my personal face to face conversation with Todd Smith (dist 92), he said he would certainly vote for it if it came up. I'm trying to convince him to either sponsor or introduce the bill that was drafted here.

How about others - what sort of feedback?

Nothing from my rep yet (Frost), but I got this back from my senator:

Mr. Craig,
Thanks for your email. I agree with you and have always and will
continue to fully support expanding right to carry.

Thanks again,

Well, I just voted and NO...I did not vote for Eddie Rodriguez.
I don't know the issue surrounding Rodriguez, but all his response said is that he isn't interested in FILING the bill. He didn't say he wouldn't support it, and in fact his reply indicates otherwise.

'Course, I'm no longer a TX voter, but my daughter is, so I'm interested.

If he is an advocate for gun control as his response says, then he loses my vote for that. These days, I am very cut and dry about that.

D'oh. I completely misread his response.

Can't believe I read it so wrong.

Snail mail sent today to Gov. Perry, Sen. Hinojosa and Rep. Herrero.

Responses will be posted when received.

Edit, Gov Perry's reply received. Seems like a general response but I find it very cordial and very informative as far as the links provided to get me further on my task of contacting legislators about my concerns (which has already been done). Thank you Dede Keith & Gov Perry's office for the reponse:

Dear Ms K---,

Thank you for taking the time to contact the Office of the Governor. I have shared your views with our legislative and Budget, Planning and Policy division staff.

You may consider sharing your recommendation with legislators as well, given that they are the officials with the authority to introduce and vote on legislation. You may obtain contact information for state legislators at the web sites listed below:

--General Texas legislative information can be found at: http://www.capitol.state.tx.us/

-- To see who represents you (and find contact information), please go to: http://www.fyi.legis.state.tx.us/

Please let us know whenever we may be of service in the future.
