So I'm wondering if its legal to OC on public transportation (city bus) or if that's considered concealing since it's inside the vehicle.

I doubt anyone here will have a definitive answer, but I'd love to hear what you think about this one.

As for the public transportation:

In my mind, since most public transportation is owned or operated by a local government, then preemption, to me, would cover you in this instance.

As for the Concealed or not:

I believe the law surrounding this subject says "the weapon is considered concealed when you enter A vehicle", not YOUR vehicle. So I would consider it concealed. Opinions differ though, and it will be interesting to see what the other members here think.

I agree, it does not specify your vehicle. Hence it would be a violation if you did not have a CPL. If you have a CPL, this would not constitute a violation of the statute. It does however pose the question...
IF, the bus, cab, etc.... IS owned by the city...does pre-emption apply since it is there to provide a service to the public? Hmmmm....

Don't forget that some pubic mass transit have contracts to carry students, and may be perceived as a school bus. I just throw that out there because of that pesky thing called a lawyer.

It's a streeeeetch

Well, I ride the Ann Arbor public transportation (http://theride.org/), and I know for a fact that they contract the university. As an employee of the U, I can ride for free. So can all students...

Interesting topic. Please continue.

correct me if I'm wrong, but I'm pretty sure that the "school transportation" deal would only apply to pre-12. although, city transportation does carry a lot of h/s and elementary students. hmmmm.

don't even think about it until you talk to a half dozen lawyers, and they all agree, that it's legal. :p

IMO, with a CPL, if you OC or CC you would not be in violation of any firearm laws in Michigan. However, you maybe in violation of MTA's policy that may indicate that weapons (firearms) are not allowed. At this point, about all they can do is ask you to leave and/or call 5-o.

I have to agree with Tucker6900, if the vehicle is owned and operated by a municipality, and is intended for public use, then preemption would apply.

I also agree with him about the wording concerning "in a vehicle" If it were "YourVehicle" thenany time I rode with a friend or acquaintance it would notbe concealed.

I would imagine that it would be impossible to get two or more lawyers to agree on anything...
