    Proposed Gun Show Loophole law might sink gun buy backs!

    Cliff notes:

    1. Gun buy back = firearms show, 2. seller = firearms vendor, 3. promoter must verify vendors (sellers) before a firearms show begins – this requirement kills the buy back.

    I think that the proposed legislation to “close the gun show loophole” would actually ruin any police gun buy back. The cites are from the proposed legislation, SB 1257. The link is at the bottom.

    "Firearms show" means the entire premises, including but not limited to parking areas, of any gathering or exhibition, open to the public, not occurring on the permanent premises of a dealer in firearms, conducted principally for the purposes of exchanging, selling or trading firearms as defined in § 18.2-308.2:2.

    Reasoning:


    A Gun Buy Back is a gathering, open to the public, not at the permanent premises of a dealer in firearms, conducted principally for the purpose of selling firearms therefore it is a “firearms show”

    2.Each seller at the gun buy back ( firearms show) fits the definition of a firearms show vendor

    "Firearms show vendor" means any person not licensed as a Virginia dealer pursuant to 18 U.S.C. § 921 et seq. who exhibits, sells, offers for sale, transfers, or exchanges any firearm at a firearms show, regardless of whether the person arranges with a firearms show promoter for a fixed location from which to exhibit, sell, offer for sale, transfer, or exchange any firearm.

    Reasoning:

    A person, not a Virginia firearms dealer, who sells or exchanges any firearm at a firearms show (gun buy back) is a firearms show vendor.

    3.The gun buy back / firearms show promoter (gun show buy back police department) must, before the start of the firearms show, verify the identity of each participating firearms show vendor

    Before the start of the firearms show, the promoter shall verify the identity of each participating firearms show vendor by examining a photo identification issued by the Virginia Department of Motor Vehicles or a similar agency in the vendor's state of residence if the vendor is not a Virginia resident and require the vendor to sign a ledger with identifying information concerning the vendor. Also, before the start of the firearms show, the promoter shall provide each vendor with a notice advising the vendor of the obligations of the vendor under this chapter and § 18.2-308.2:4. The promoter shall maintain a copy of the records described in this subsection at the permanent place of business of the firearms show promoter for four years from the date of the firearms show.


    Reasoning:


    This means that the police must verify the identity of all sellers before a firearms show (gun buy back) begins, collect identifying information on all sellers and maintain the collected information for 4 years.

    This essentially kills the gun buy back because the police cannot predict who will come.

    The police must also give notice to people (firearms vendors) before they come to the gun buy back

    It would work. For about 8 seconds. Until they amended the law to except LE or those with permits from the Gov's brother-in-law's cousin.

    I'd suggest we just take the simpler route of opposing the "loophole" bill, and supporting the "kill gun buybacks" bill:

    Seriously, however, this bill doesn't "kill" buybacks, but specifies that any buyback program dispose of the firearms aquired via auction to FFLs. I suppose we could debate on whether it's better to leave unwanted guns in the attic, or have them back on the market to law abiding citizens.

    The "gun show loophole" bill made it out of the senate committee today. Anti support for the bill will be weakened if they understand that this is also the "kill the gun buy backs" bill.
