Rules on using a recorder in NC?

If the need arises am I required to inform the LEO that he's being recorded? Is the recording admissable if I didn't?

You are not required, as NC is a one party state.

I can not think of any reason it would not be admissible.

Just to clarify, one party means that, in a two person conversation, only ONE person must be aware of the recording. You count as that one person, so you're free to record any and all conversations you have, as long as you're aware that you're doing it.

Now I have a question, though. What if, during the course of a stop, a second officer approaches, and converses with the first officer while you're standing there. Do you still count as being a party to the conversation since you're all right there, or does that become a separate, two party conversation that you're not allowed to record?

I would venture to say you are still part of the conversation even if you aren't contributing, unless they walk away.

I would tend to agree with you. Logically this makes sense, but we all know how often logic plays a roll in anything legal. :?
