Yes this was my first time. Yes i knew i gave too much, but overall it was good learning experience. They waiting for me on the other side of the street. I believe it was officer Douglas and Officer Kaiser. Officer Kaiser was Officer 2 in this recording. About 15minutes of us walking around trying to find our way to the group i was confronted.

(Laspe Time 14:40)Officer 1: Can I talk to you for a sec?

Me: Certainly

Officer1: Do a quick check on your weapon to make sure its not loaded.

Me: Sure

I put my arm on my head ( military habit)

Officer1: just put your arms in front of you.

Officer2: yeah just put them in front of you

Officer1: This a very non ….garbble…..Is this a 1911?

Me: Yes Sir

Officer 2: Whats your name?

Me: Mike

Officer2: mike?

Officer1: Were you carrying Cocked and locked?

Me: No Sir

Officer2: Whats your last name?

Me: uuuhhh ( i gave it to him)

Officer 2: (He repeats it)?

Me: uh yeah

Officer2: How do you spell it? (he states the first three letters)

Me: Yup.

Officer1: Are those Spike?

Me: Spike?

Officer1: Those glasses

Me: I don’t know

It become inaudible due to traffic but I picked up their radios

There was some other small talk by Officer one then it the bus left and audio continues

Officer 1: Who’s gun is that?

Me: Mine

Officer1: No,no,no. Who makes it?

Me: Colt

Officer: Colt Commander? Everybody and there brother has one …inaudible

Me: They are now, yeah.

Radio: ….34 Baker.

Radio2(female voice): 34 Baker

More traffic which makes it inaudible

Me: Its beautiful out here. Is it always like this?

Officer 1: Not during the winter. But …inaudible

Officer1:Where you from?

Me: Northern Cal

Officer2: Where abouts from northern California

Me: Sacramento

Officer2: you came down all the way for this?

Me: no

Officer2: no?

Me: I uh, actually came looking for a job

Officer2: Down here? What kind of job you looking for?

Me: One that is hiring

(we all start laughing)

Officer2: So whats your address up there?

Me: …..

Officer2: Do you know your driver license number?

Me: no not off the top of my head.

Officer2: do you have it on you?

Me: no

Officer 2: What about your birthday?

Me: ( yeah I apparently gave him my B-day)

Officer1: absolutely you have to be identified

ME: So you have to carry it on your persons?

It was hard to hear what they were saying because of the car alarm going off in the backround

Officer: Yeah, you do need to have it on you

ME: Yeah,

Me: yeah.

Officer 1: You do need to have one.

Me I thought that was only for driving?

Hard to hear over the traffic

At least the car alarm had stopped

Officer2: going to get something to eat?

Me: Yeah, trying to meet everybody else. Is that everything Officer?

Officer2: Yeah you are all set

Me: Alright, thank you

Officer2: sounds like he said “sorry bro”

When I run in to LEO doing a 12031 check, I plan to comply with inspection but respectfully only give my name and address. I learned the hard way as a youth "not to talk to police". Nothing good will come of it. Their only goal is to get you to admit to breaking some law. I also find it strange that most LEOs I encounter take my silence as an offense to them, it often "escalates" the situation. But I'd rather tick off some cop by not answering questions than get a ticket or go to jail.

I made many mistakes while talking to police and the only way I learned was repeated encounters with them, so keep it up

I would definitely pass this along to the Lt. and put in an official complaint.

You were not required to provide I.D. Officer Kaiser flat out lied to you about having to carry I.D.

He was fishing for as much information as he could possibly get from you. And you bit hook line and sinker.

My 12031(e) check went as follows:

Approached by two officers, Officer 1: Male, Officer 2: Female

Officer 1: "Excuse me sir, We need to check you weapon."

Me: "I don't consent to any warrentless searches, but if you demand to check my weapon, I will comply with your instructions."

Officer 1: "Please keep your hands where they are."

Officer 2: (Silent through entire encounter)

Officer 1: After removing my weapon from it's holster "What kind of gun is this?"Quickly performs e-check and returns weapon to holster.

Me: "Hi-Point C9"

Officer 1: "Thanks, have a nice day!"

Done.

No interrogation, no request for I.D., no request for Driver's License, no request for address, no request for date of birth, no request for a prostate exam.

The standard answer to any request for personal information is, "I don't see how that is relavent to this interaction! Am I being detained? If not, I would like to be about my business. Have a nice day!"

I would hold off on giving my name and address. It is not a legal requirement in California to identify yourself to a police officer unless you are being investigated for criminal activity.

a 12031(e) check is NOT a criminal investigation, so there is no legal requirement for them to know anything about you at all. If they say that they need to ensure that you aren't a felon in possession of a firearm, tell them no they don't. If they aren't holding you for suspiscion of ACTUAL criminal activity, then you are done with this interview and will now be on your way unless they intend to arrest you.

It sounds scary, but the cops are FISHING.

I'll try that. Thanks. I have a flexible employer and a wife that is more worried about what I'm wearing while OCing than the fact that I'm actually OCing

So if I'm detained for the day while my lawyer comes to bail me out, I'll be fine.
