One can drink a glass of wine with a meal, and not be 'under the influence' of it.

Personally, I don't drink. Ever. Just not for me. But I've yet to see a person drink a single mildly alcoholic beverage and instantly become falling down drunk and lose all sense...

That phrase is also used in drunk driving laws, it could easily be argued that the same BAC levels apply here, as they are using the same exact language to describe it.
