Hey does anyone have the officialand currentword on Las Vegas, Nevada regarding OC and the supposed new firearm registration law. My Son, his Wife, and my 2 grandchildren are there for the week end and asked me to look up the OC laws for Nevada and I was shocked to see things have taken an ugly change with the registration law for Clark County only. Apparently its being disputed because state law says that city or county law can't supersede state law and state law doesn't require registration or at least at the time of the Clark County law being enacted state law had not required registration. this took place some time in 2007 from what I read. The post in so many words stated that if your going to be in Clark County for more than 24 hrs. you must go to the sheriff dept. and register your weapon. But I also read that they were having problems with prosecuting such cases in which a person arrives in Clark on the weekend the dept. entity that performs the registration process closes at5:00 PM on Fridays and doesn't open until Monday morning making it impossible to comply with the law. And as most of us know Vegas is usually a weekend thing for most people. It was suggested to arrive after 5:00 PM and leave before opening time Monday. I've always OC in all parts of Nevada and have never been approached about it from anyone. I guess I'm lucky to not have been charged with a crime I guess?

You can be in Clark County for sixty days without registering your handguns. Residents have 72 hours to register handguns. You can open carry in Las Vegas without a permit, just like in the rest of Nevada.

The preemption statute specifically allows for Clark County to maintain handgun registration. While some are lobbying to get this removed it is the law.

Also, while the law says that regulation is reserved for the state legislature (other than discharge and the allowance of Clark to register), the current Nevada attorney general website says that the law doesn't do anything. North Las Vegas has an ordinance against firearms in vehicles.

If you ask your question in the Nevada section you may get more responses.

Thanks for the heads up on this. When you say that N. Vegas has an ordinance prohibiting firearms in automobiles what exactly does this mean, OC, CC, handguns, and so on? You havesome first hand knowledge so please share with me what you know as I travel to Nevada often and don't want to wind up in the big house.

Thanks,

Here is the North Las Vegas Municipal Code:

http://municipalcodes.lexisnexis.co...A/TITLE09/Chapter_9_32_WEAPONS_GENERALLY.html
9.32.080 Deadly weapon prohibited in vehicle--Exceptions.

It is unlawful for any person to have in his possession in any automobile, truck, motorcycle, or any other type of vehicle any dangerous or deadly weapon, but this restriction shall not be deemed to prohibit the carrying of ordinary tools or equipment carried in good faith for uses of honest work, trade or business, or for the purpose of legitimate sport or recreation. (Ord. 596 § 1, 1978: prior code § 7.22.070)

There are a few other municipal codes in that link, including the definition of a weapon and a code saying no loitering with a weapon.

The state law should technically preempt these codes despite disagreement from the current AG.

Felid Maximus answered your questions right on the money. But to follow that up I live in Las Vegas and OC all the time. I have yet to have an incident of any kind in the past 6 months that I've been OC'ing. I carry a 5" 1911 and will occasionally geta surprised look from somone not used to OC but most people don't even tend to notice. Good luck!

I agree. Open carry is legal statewide. But it doesn't mean you won't get hassled by an LEO who isn't familiar with all of the law.Depends on where you go.

Be aware however that OC on "The Strip" is a completely different beast and it WILL get you stopped nearly every time an LEO sees you according to many on the NV board. Thats not to say it isn't legal on the strip, just that its a sensitive subject due to the large number of tourists.

Also, the vast majority of casinos and hotels will trespass you the moment they notice you carrying a gun, CC or OC, as private property reserves all rights as normal.

If you plan to visit the strip, I suggest you CC if you have a permit that is recognized.

Reciprocity information can be found here...http://www.handgunlaw.us/states/nevada.pdf

I have been researching open-carry in Clark County NV and found this old thread.

A friend from Ariz and I (from Calif) will be hiking the Spring Mountains National Recreation Area in the Humboldt-Toiyabe USFS National Forest.

We plan to open carry there with our 45ACPs as usual on USFS lands.

I called the rangers and they said the rules are the same as the state, that the USFS lands now follow local state law.

I called the Clark Co Sheriff and they said Nevada is a "traditional open carry state" and there are no prohibitions as long as your weapon is in plain sight.

Anyone know any differently about Las Vegas in general and the SMNRA in particular?

Thanks in advance.

Be aware this old thread is full of non-current and therefore wrong information. Best to just stick to your new thread in the NV section.
